RECOMMENDATION: |
Recommendation Concerning the Acceptance of the Donation of a Parcel of Real Property on East Olive Road from Arthur J. and Kaja G. Nowicki - Joy D. Blackmon, P.E., Public Works Department Director
That the Board take the following action concerning the acceptance of the donation of a parcel of real property located at 8101 Chapperal Drive, which is the northeast corner of the intersection of Caminitti Lane and East Olive Road from Arthur J. and Kaja G. Nowicki:
A. Accept the donation of a portion of real property, approximately 63.289 square feet, located at 8101 Chapperal Drive from Arthur J. and Kaja G. Nowicki, for road and drainage improvements;
B. Authorize the payment of documentary stamps, as the property is being donated for governmental use, which is for road and drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;
C. Authorize the payment of incidental expenditures associated with the recording of documents; and
D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept, the Warranty Deed as of the day of delivery of the Warranty Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND: |
The County has a project in design to make road and drainage improvements along East Olive Road. Due to limited right-of-way in this area, it was determined that additional property would be required to facilitate the project. Arthur J. and Kaja G. Nowicki, owner of the property located at 8101 Chapperal Drive, have agreed to donate a portion of real property, approximately 63.289 square feet, to facilitate the road and drainage improvements for the project. Board approval is required for the Board's acceptance of the donated property.

Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office. |
LEGAL CONSIDERATIONS/SIGN-OFF: |
The Warranty Deed was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney, on August 15, 2013. |
PERSONNEL: |
All work associated with this request is being done in-house and no additional staff is required. |
POLICY/REQUIREMENT FOR BOARD ACTION: |
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances. |
IMPLEMENTATION/COORDINATION: |
Upon Board approval, Staff will proceed in compliance with Section 46-139 of the County Code of Ordinances. |
