RECOMMENDATION:
Recommendation Concerning the Florida Department of Transportation Local Agency Program Agreement for Construction and for Construction, Engineering, and Inspection Services for the Perdido Key Multi-Use Path, Western Phase - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the Florida Department of Transportation (FDOT) Local Agency Program (LAP) Agreement between the State of Florida Department of Transportation and Escambia County, for Construction and for Construction, Engineering and Inspection (CEI) Services for the Perdido Key Drive Multi-Use Path from the Alabama State Line to the Western Entrance to Perdido Key State Park:

A. Approve and authorize the Chairman to sign the LAP Agreement between FDOT and Escambia County for Construction and for Construction, Engineering and Inspection (CEI) Services for the Perdido Key Drive Multi-Use Path from the Alabama State Line to the Western Entrance to Perdido Key State Park, in the amount of $1,768,953, which will be reimbursed to the County;

B. Adopt a Resolution authorizing the Chairman to sign the LAP Agreement; and

C. Authorize the Chairman to execute, subject to Legal review and sign-off, any subsequent Agreements and program-related documents for this project that do not alter the finite terms of funding amounts or budgets.

Perdido Key Drive is located in Commission District 2.
BACKGROUND:
The purpose of the Agreement is to enter into a Local Agency Program (LAP) Agreement between Escambia County (hereinafter referred to as County) and the Florida Department of Transportation (hereinafter referred to as the Department and/or FDOT), regarding funding, in the amount of $1,768,953, for construction and for construction, engineering, and inspection (CEI) services for the Perdido Key Drive Multi-Use Path, Western Phase. This project will construct approximately two miles of a multi-use path along the north side of Perdido Key Drive, formerly State Road (SR) 292. The project limits are from the Alabama State Line to the western entrance to Perdido Key State Park. Meeting in regular session on September 5, 2019, the Board approved the Road Transfer Agreement between Escambia County and FDOT which transferred ownership and maintenance of SR 292 (Perdido Key Drive) to Escambia County.

Following execution of the LAP Agreement, FDOT will authorize construction advertisement to proceed. The project construction is expected to be complete in June 2021.
BUDGETARY IMPACT:
The Department will reimburse the County up to $1,768,953 for expenses related to the construction of this project. A Supplemental Budget Amendment will be prepared by the Office of Management and Budget to recognize the funding for the LAP Agreement.
LEGAL CONSIDERATIONS/SIGN-OFF:
The LAP Agreement and the Resolution have been reviewed and signed off on by the Escambia County Attorney's Office.
PERSONNEL:
No new personnel will be required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board policy requires Board approval of all Agreements.
IMPLEMENTATION/COORDINATION:
Upon Board approval, Escambia County Engineering staff will coordinate with FDOT staff and the Office of Purchasing for procurement of construction Contracts.
