RECOMMENDATION:
5:31 p.m. Public Hearing for consideration of adopting an Ordinance creating the Homeplace Lane Roadway Improvements MSBU.

Recommendation:  That the Board adopt, and authorize the Chairman to sign, the Ordinance creating the Homeplace Lane Roadway Improvements Municipal Service Benefit Unit (MSBU), and all related documents, and make the following findings of fact:

A. Lots in the District are specially benefited since roadway improvements increase the market value of an individual lot, provide individual lot owners with an appropriate and adequate transportation route in the area, and increase the ability of owners to develop their land;

B. The non-ad valorem special assessments levied represent a fair and reasonable apportionment of the cost of the special benefit received by each lot and do not represent a fair share of the cost of general governmental service provided to residents in the unincorporated areas of Escambia County; 

C. Lots which do not receive a special benefit have been and shall be excluded from the non-ad valorem special assessment for roadway improvements; and

D. The Board is not accepting ownership of any roads, streets, easements, or lots located within the District, and shall not maintain any such properties within the District during or after completion of improvements in the District.
BACKGROUND:
The owners of property abutting Homeplace Lane have met the criteria established by the Board for an MSBU, and the Board has reaffirmed its intent to use the uniform method of collection of non-ad valorem special assessments levied for roadway improvement projects. Now the property owners wish to establish the MSBU for the purpose of providing roadway improvements.   

The County is not accepting ownership or maintenance responsibilities of Homeplace Lane after improvements are complete, therefore the roadway is not being required to meet County code compliance.  This is a one-time improvement project with no future County responsibility.

Petitions for creating the MSBU district were circulated among the 16 Homeplace Lane property owners, and of these, 14 property owners (87.5%) signed the petition in favor.  This meets the 66% minimum approval requirement specified in the MSBU Guidelines and Procedures. The estimated cost per residential lot will be $383.54 annually for 5 years.
BUDGETARY IMPACT:
The MSBU will generate revenues for the purpose of providing repayment to Escambia County for providing roadway improvements to Homeplace Lane, as well as administrative and statutory fees.
LEGAL CONSIDERATIONS/SIGN-OFF:
This Ordinance has been reviewed by the County Attorney's Office and found to be legally sufficient.
