RECOMMENDATION:
Recommendation Concerning the Acquisition of Property Located at 1000 Pinoak Lane - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the acquisition of a parcel of real property (approximately 4.07acres), located at 1000 Pinoak Lane, from John J. and Valerie L. Davis:

A. Authorize the purchase of this property, located at 1000 Pinoak Lane, for the averaged appraised value of $318,500, from John J. and Valerie L. Davis;

B. Approve the Contract for Sale and Purchase for the acquisition of a parcel of real property located at 1000 Pinoak Lane (approximately 4.07 acres); and

C. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the acquisition of this property without further action of the Board.

This property is located in Commission District 5.

BACKGROUND:
Pinoak Lane (aka Pinoak Drive - please see attached GIS letter) a small, dead-end street that serves about 18 homes and provides these residents access to US Highway 29, intersects US Highway 29 just south of a large cross drain (4 barrel, 4’ x 10’ box culvert).  Pinoak Lane itself has two (2) 30” Reinforced Concrete Pipes (RCPs) serving as a cross-drain on one of the bends in the road. This area of Pinoak Lane is known to have drainage problems including overtopping and one home flooding (1000 Pinoak Drive). Repetitive home, street, and yard flooding has been confirmed by photos and flood insurance claims. 

This location receives runoff from approximately 2,000 acres of drainage area. Upstream of this location are twelve (12) separate cross-drains, which all contribute stormwater from different locations. Once to Pinoak Lane, the water flows just to the south and parallel to the road, then crosses Pinoak Lane, where the only stormwater provision is the two (2) 30” pipes mentioned above.  

The hydraulic analysis performed under the Jacks Branch Basin Study confirms that stormwater improvements such as larger pipe or ponds will be unable to prevent flooding at 1000 Pinoak Drive during a 100-year storm event. Flood elevations in this location seem to be controlled by the flow path adjacent to the home, which is simply too flat to carry peak flows without extremely high water surface elevations. 

The September 29, 2006, Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps (FIRM - Map No. 12033C0240G) do not identify this area as a Special Flood Hazard Area, because the FEMA study does not reflect the area east of US Highway 29. However, the Jacks Branch Basin Study does indicate that the south end of Pinoak Lane is in the special flood hazard area. The Northwest Florida Water Management District (NWFMD) and FEMA are aware of this discrepancy, and the area is currently under study and review for map amendments by the NWFMD. The Preliminary FIRM released on January 27, 2017 (available at www.nwfwmdfloodmaps.com), demonstrates that 1000 Pinoak Lane is in flood zone A. 

The purchase of this property is 100% funded through the Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP). Meeting in regular session on June 7, 2018, the Board of County Commissioners approved Federally- Funded Subaward and Grant Agreement #18HM-H4-01-27-01-394, Project 4177-29R for acquisition, demolition, and open space conversion of 1000 Pinoak Lane.

The County proposes to acquire 1000 Pinoak Lane, remove the structure, infrastructure, and debris, and grade and sod to return the property to natural space. 

Two appraisals were obtained for the purchase of this property - $340,000 and $297,000 - providing an average purchase price of $318,500, which the property owners have agreed is a fair price.

Funding for this project is available in Fund 352, LOST III, HMGP Pinoak Lane Acquisition, Cost Center 210130, Object Code 56101, Project #18EN4055.

The Contract for Sale and Purchase has been approved by Stephen G, West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
