RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Vacation of a Portion of Unopened Right-of-Way Known as Rentz Avenue - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding a Petition to Vacate a Portion of Unopened Right-of-Way known as Rentz Avenue, as petitioned by Michele Mayfield Slowey-Blankenship:

A. Authorize the scheduling of a Public Hearing for October 3, 2019, at 5:31 p.m., to consider the Petition to Vacate a Portion of Unopened Right-of-Way Known as Rentz Avenue (approximately 0.40 acres), as petitioned by Michele Mayfield Slowey-Blankenship; and

B.  Require the Petitioner to notify all property owners within a 1000-foot radius.

The real property mentioned in this Petition to Vacate is located in Commission District 2.
BACKGROUND:
This portion of Rentz Avenue is an unopened right-of-way located south of Gulf Beach Highway. The Petitioner's family has owned the property located at 2531 Gulf Beach Highway since 1951. The Petitioner is requesting that the county vacate a portion of the unopened right-of-way west of her property known as Rentz Avenue (approximately 0.40 acres). 

Staff has reviewed the request and there are objections to this request due to the ongoing Beach Haven Drainage Project.  Planning and Zoning staff noted that the subject area serves as a buffer between this property’s residential zoning and the heavy commercial/light industrial zoning to the west. Should that adjacent parcel be later developed for commercial use, buffering will be required of the developer of the commercial-use property.

Emerald Coast Utility Authority (ECUA) has no infrastructure in the subject area; however, they would like to retain a Utility Easement for potential future sewer expansion projects along Gulf Beach Highway. Gulf Power will need an Anchor Easement for the subject area, and AT&T, MCI, Peoples Water Service, Quanta Telecommunication Services, and Pensacola Energy state that they have no objections to this vacation request.   

There is an existing fence encroachment within the unopened right-of-way.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION:

Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all owners of property within 1000 feet will be notified.
