RECOMMENDATION:
5:31 p.m. Public Hearing for Consideration of the Petition to Vacate Unopened Rights-of-Way Between Navarro Road, San Carlos Road, West Plaza Road, and Santa Rosa Road, as petitioned by Robert E. Pierce. 

Recommendation: That the Board take the following action concerning the Petition to Vacate Unopened Rights-of-Way Between Navarro Road, San Carlos Road, West Plaza Road, and Santa Rosa Road: 
  
A. Approve or deny the Petition to Vacate Unopened Rights-of-Way Between Navarro Road, San Carlos Road, West Plaza Road, and Santa Rosa Road, (approximately 1.58 acres), as petitioned by Robert E. Pierce;

B. Accept the Hold/Harmless Agreement;

C. Adopt the Resolution to Vacate; and

D. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.

The real property mentioned in this Petition to Vacate is located in Commission District 5.
BACKGROUND:
This Petition to Vacate is for property located north of Muscogee Road and west of Highway 29 in Block "B" of the Pensacola Highlands Subdivision. The Petitioner owns Lots 27, 28, 35, 36, 37 and part of Lot 34. There are two unopened rights-of-way running between the Petitioner's property, a 20-foot unopened right-of-way running north and south, and a 60-foot unopened right-of-way running east and west.

Lots 27 and 28 are undeveloped, wooded lots. Lots 34, 35, 36 and 37 are developed residential lots. Petitioner would like to make the property one contiguous parcel. 

Staff has reviewed the request, all concerned utility companies have been contacted, and there are no objections to the Vacation of this property.

Property owners within a 1000-foot radius were notified.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

Not applicable.

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

This recommendation is based on the Board's Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County Owned property- Section III, and Florida Statues, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Petition to Vacate, the necessary documents will be signed and it will be the responsibility of the Petitioner to have the documents recorded in the public records and to advertise the required public notifications.
