RECOMMENDATION:
Recommendation Concerning Authorization for the Acquisition of Real Property Located at 991 Cody Lane - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning authorization for the acquisition of real property located at 991 Cody Lane (approximately 0.77 acres) from The James G. Linker Living Trust and Charles W. Hawk:

A. Authorize the purchase of 991 Cody Lane (approximately 0.77 acres) owned by The James G. Linker Living Trust and Charles W. Hawk, for the purchase price of $69,500; 

B. Approve the Contract for Sale and Purchase for the acquisition of real property located at 991 Cody Lane;

C. Accept the Public Disclosure of Interest Form from The James G. Linker Living Trust; and

D. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute, subject to Legal review and sign-off, any documents necessary to complete the acquisition of this property without further action of the Board.

This parcel is located in Commission District 3.

BACKGROUND:

The Florida-Alabama Transportation Planning Organization (TPO) tasked the General Planning Consultant to generate a corridor management plan for Detroit Boulevard/Johnson Avenue, which was approved in April 2018. Under the plan, staff collected traffic, land use, environmental, and economic data for the area surrounding the Detroit Boulevard/Johnson Avenue corridor, to address short-term and long-term improvements for the subject corridor in efforts to provide a better, safer environment.

One of the recommended improvements of the plan was to improve the level of service for the intersection of Johnson Avenue and Cody Lane by installing a new traffic signal with an eastbound right turn lane. The turning volume, split between eastbound left and eastbound right turns, causes a significant queue at peak times that often prohibits drivers from accessing the intersection to turn right. Acquisition of the subject property will provide the space needed to install the eastbound right turn lane and any stormwater runoff.

The property was recently listed for sale at $79,000; however, the owners have agreed to sell the property for the appraised value of $69,500. 

BUDGETARY IMPACT:
Funds are available in Fund 352, LOST III, Cost Center 210107, Object Code 56101, Project 13EN2523.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Contract for Sale and Purchase has been approved by Stephen G. West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances. 
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
