RECOMMENDATION:
Recommendation Concerning the Acquisition of Real Property Located at 5538 Glass Drive - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the acquisition of real property located at 5538 Glass Drive (approximately 0.46 acre), from Richard B. Herring, for the Blue Springs at Crescent Lake Project:

A. Authorize, by super-majority vote, the purchase of a parcel of real property located at 5538 Glass Drive (approximately 0.46 acres), from Richard B. Herring, for the purchase price of $41,200;

B. Approve the Contract for Sale and Purchase for the acquisition of a parcel of real property located at 5538 Glass Drive (approximately 0.46 acre); and

C. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute, any documents, subject to Legal review and sign-off, necessary to complete the acquisition of this property without further action of the Board.

This parcel is located in Commission District 1.

BACKGROUND:
During the April 2014 storm event, the area of Blue Springs Avenue within the Crescent Lake Subdivision suffered significant damage to public infrastructure and private properties. Escambia County responded with the Crescent Lake Dam Project (funded by National Resources Conservation Services), the Blue Springs Avenue FEMA repair project, and the East Shore Drive FEMA outfall pipe replacements to Crescent Lake.

Given the extent of damage, the Blue Springs Avenue at Clearwater Avenue Drainage Analysis was also completed to identify drainage deficiencies and determine the best alternatives to prevent recurrence of such stormwater or drainage impacts. Stormwater attenuation improvements in the upstream basin contributing to the Blue Springs Avenue area were determined to be necessary in the Sun Valley Drive, Glass Drive, and Clearwater Avenue areas. Potential stormwater improvements for Empire Pit were also referred to the Florida Department of Transportation for consideration. The recommendation is to maximize the stormwater pond volume, depending upon successful property acquisition. 

This parcel, adjacent to Crescent Lake Subdivision, is adjacent to the previous upstream and downstream parcels purchased in the area. To optimize flood reduction, and improve water quality for Crescent Lake, this purchase is necessary to interconnect and maximize pond volumes. 

Meeting in regular session on November 30, 2017, the Board approved the property owner's counteroffer of $41,200 (appraised value $37,500). 
BUDGETARY IMPACT:

Funding is available in Fund 352, LOST III, Cost Center 210107, Object Code 56101, Project #15EN3252 "Crescent Lake."

LEGAL CONSIDERATIONS/SIGN-OFF:
The Contract for Sale and Purchase has been reviewed and approved by Stephen West, Senior Assistant County Attorney. The County Attorney's office will prepare the closing documents and conduct the closing for the purchase of this property.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
