RECOMMENDATION:
Recommendation Concerning Amendment No. 3 to Grant Agreement No. S0705 with the Florida Department of Environmental Protection and the Florida Fish and Wildlife Conservation Commission - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board take the following action concerning Amendment No. 3 to Grant Agreement No. S0705 with the Florida Department of Environmental Protection (DEP), and the Florida Fish and Wildlife Conservation Commission (FWC), to provide financial assistance for increased compliance with Article 5, Section 4-5.8, of the Land Development Code:

A. Approve Amendment No. 3 with DEP (Agreement No. S0705), and FWC (Agreement No. 13212), to provide an increase of $150,000 of financial assistance for increased compliance with Article 5, Section 4-5.8, of the Land Development Code, relating to lighting retrofits on Pensacola Beach to minimize impacts to nesting beaches; and 
 
B. Authorize the Chairman to sign Amendment No. 3 and any future amendments relating to no-cost extensions, subject to Legal review and sign-off, without further action of the Board.

BACKGROUND:
At the July 24, 2014 Regular Board Meeting, the Board approved DEP Grant Agreement No. S0705 funded by FWC through the Natural Resource Damage Assessment (NRDA) process to offset impacts to nesting sea turtles as a result of the Deepwater Horizon Oil Spill. Lighting surveys have been completed for Perdido Key and Pensacola Beach, identifying light sources impacting nesting beaches. Amendment No. 3 will provide additional financial assistance for lighting retrofits on Pensacola Beach to increase compliance with Article 5 Section 4-5.8 of the Land Development Code and minimize lighting impacts to nesting beaches.
BUDGETARY IMPACT:
Fund 110, Other Grants & Projects Fund, Cost Center 221022. No matching funds required.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Senior Assistant County Attorney, has provided legal sign-off on DEP Agreement No. S0705 Amendment No. 3.
PERSONNEL:
No additional impact to personnel associated with this recommendation. Natural Resources Management staff will continue to manage the Grant.

Board Policy II.B.8.
IMPLEMENTATION/COORDINATION:
Natural Resource Management staff will continue to manage the grant and coordinate with FWC and DEP.
