RECOMMENDATION:
Recommendation Concerning the Memorandum of Understanding Between Escambia County and the City of Pensacola Relating to the Hollice T. Williams Stormwater Park RESTORE Project - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board approve and authorize the Chairman to sign the Memorandum of Understanding (MOU) between Escambia County and the City of Pensacola relating to the Hollice T. Williams Stormwater Park RESTORE Direct Component (Pot 1) Project.
BACKGROUND:
On September 7, 2017, the Board approved and authorized staff to submit the 2016-2017 RESTORE Multi-Year Implementation Plan (MYIP) to the U.S. Department of Treasury. On October 20, 2017, the U.S. Department of Treasury approved the MYIP, finding it to be consistent with the RESTORE Act. The MYIP includes ten Board selected projects.
 
At the January 11, 2018 Committee of the Whole Workshop, the Board directed staff to develop a Memorandum of Understanding (MOU) with the City of Pensacola, instead of a subrecipient agreement, to memorialize the County and City’s responsibilities related to the Hollice T. Williams RESTORE Project. Staff has worked with City of Pensacola representatives to develop this MOU to ensure County and City outcomes are clearly expressed. The Hollice T. Williams RESTORE Project MOU states the County will oversee project management and procurement and the City will provide technical support and sign-off prior to approval of any associated deliverables.
BUDGETARY IMPACT:
No budgetary impact associated with this recommendation.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Senior Assistant County Attorney, has provided legal sign-off on the MOU.
PERSONNEL:
No impact to personnel associated witht this recommendation.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board Policy II.B.8.
IMPLEMENTATION/COORDINATION:
Natural Resources Management Department staff will coordinate with City of Pensacola staff to implement the terms of the MOU.
