RECOMMENDATION:
Recommendation Concerning the State of Florida, Division of Emergency Management, Federally-Funded Subgrant Agreement - Flood Mitigation Assistance Grant Modification Number 1 - Tim Tolbert, Building Official, Department Director

That the Board take the following action concerning the State of Florida, Division of Emergency Management, Federally-Funded Subgrant Agreement - Flood Mitigation Assistance Grant Modification Number 1:

A. Approve Modification Number 1 to the Subgrant Agreement between the Division of Emergency Management and Escambia County, to modify the Federally-Funded Subgrant Agreement - Flood Mitigation Assistance Grant Program, providing reinstatement of the Agreement, extending Project Number FMA-PJ-04-FL-2015-020 through October 31, 2019, and decreasing the Federal Funding by $145,329.04, for the maximum amount payable under the Agreement to be $314,435.25; and

B. Authorize the Chairman to sign the Agreement.
BACKGROUND:
The State of Florida Division of Emergency Management distributes grants for the mitigation of repetitive losses.  The State issues these funds to jurisdictions as subgrant recipients to be used for prevention of repetitive losses.  Escambia County, as a participant in the National Flood Insurance Program ("NFIP"), was qualified and eligible to receive these grant funds for the locations specified under the Agreement.  The grant fund is being administered by a DEM approved third party, Arcadis U.S., Inc., pursuant to the original Agreement that was approved by the Board of County Commissioners and signed by the Chairman on July 26, 2017.  The original Agreement had an expiration date of October 30, 2018 and a Federally Funded amount of $314,435.25.  This modification was previously approved by the Board, however the agreement was not executed by the State DEM prior to the expiration date. The State DEM has now provided this revised modification to reinstate the agreement, to extend the expiration date to October 31, 2019, and to decrease the Federally Funded amount by $145,329.04.  The decrease in the Federally Funded amount is the result of the withdrawal from the grant program received from recipient Fumi Watson.  
BUDGETARY IMPACT:
This DEM Subgrant is federally funded and insludes a cost share by each Grant Recipient.  Escambia County, as the sub-recipient, will be required to reimburse the Grant Recipients and then receive reimbursement for those expended funds from the State.  Grant administration fees are also paid from the funds.
LEGAL CONSIDERATIONS/SIGN-OFF:
This Modification to the previously approved Agreement has been reviewed and approved as to form and legal sufficiency by Kia Johnson, Assistant County Attorney.

POLICY/REQUIREMENT FOR BOARD ACTION:
The Board requires its approval of Agreements and Modifications to approved Agreements.
IMPLEMENTATION/COORDINATION:
Upon final approval by the Board and the State, the Escambia County Building Services Department will coordinate with the State of Florida and the approved third party administrator regarding the projects.
