RECOMMENDATION:

August 3, 2018 communication from Amanda Barnes requesting relief for the Community Development Block Grant (CDBG) Program Mortgage for property located at 33 Camelia Drive.

BACKGROUND:

On July 28, 2006 John Hadden entered into one mortgage and two lien agreements for his homestead property at 33 Camelia Drive for major rehabilitation to be performed under the Community Development Block Grant (CDBG) Program. The two liens expired after five years and have been released. The $20,385 mortgage (Exhibit I) executed at the time does not have an expiration, but under F.S. 95.281, the mortgage expiration is limited to 20 years. Mortgage terms dictate repayment of the loan upon sale or transfer of the property.

Mr. Hadden passed away in February 2018. Mr. Hadden's daughter, Amanda Barnes, submitted a written communication (Exhibit II) requesting that the Board consider releasing the CDBG lien from 2006 due to the condition of the home and that her father did not understand the loan documents.

BUDGETARY IMPACT:

Ms. Barnes' written communication states that there is a first mortgage on the property with approximately $17,500 still owed. The property appraiser's website values the property at $50,818 (Exhibit III).

POLICY/REQUIREMENT FOR BOARD ACTION:

Any variance from CDBG mortgage and program policy must be reviewed and approved by the Board. Ms. Barnes was provided a copy of the Housing Rehabilitation Loan Assumption Policy adopted by the Board in March 2016 for consideration.

IMPLEMENTATION/COORDINATION:

If mortgage relief is granted, Neighborhood Enterprise Division will prepare a Cancellation of Mortgage.
