| RECOMMENDATION: |
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Petition to Vacate a Portion of Unopened Right-of-Way Known as Grande Boulevard - Joy Jones, P.E., Public Works Department Director
That the Board take the following action regarding a Petition to Vacate a Portion of Unopened Right-of-Way known as Grande Boulevard:
A. Authorize the scheduling of a Public Hearing for December 6, 2018, at 5:31 p.m., to consider the Petition to Vacate a Portion of Unopened Right-of-Way known as Grande Boulevard (right-of-way varies due to the shoreline of Bayou Grande), as petitioned by Carole A. Lockhart; and
B. Require the petitioner to notify all property owners within a 500-foot radius.
This request is located in Commission District 2. |
| BACKGROUND: |
Grande Boulevard, located in Block 24 of Beach Haven Subdivision, is an unopened right-of-way that meanders along Bayou Grande.
The petitioner, Carole Lockhart, is requesting the county to consider a Petition to Vacate a portion of the unopened right-of-way, known as Grande Boulevard, behind her property, located at 2019 Augusta Avenue. This would then create water frontage for Ms. Lockhart.
Staff has reviewed the request and has concerns with vacating direct water access as that would possibly prevent or complicate future restoration projects in the area. All utility companies have been contacted and have no objections to the vacation of this property. |

| POLICY/REQUIREMENT FOR BOARD ACTION: |
| Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336. |
| IMPLEMENTATION/COORDINATION: |
| Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all owners of property within the area determined by the Board will be notified. |
