RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Petition to Vacate a Portion of Delano Street - Joy Jones, P.E., Public Works Department Director

That the Board take the following action regarding a Petition to Vacate a portion of Delano Street: 

A. Authorize the scheduling of a Public Hearing on November 1, 2018, at 5:31 p.m., to consider the Petition to Vacate a portion of Delano Street, as petitioned by the owner, James W. Kiker; and

B. Require the Petitioner to notify all property owners within a 500-foot radius.

This petition refers to an area located in District 3.
BACKGROUND:
Delano Street is located east of Market Street and runs parallel to Fairfield Drive.  

The petitioner, James Kiker (agent, Teresa Kiker), has filed a Petition to Vacate approximately 1,001 feet of Delano Street, lying east of the Market Street intersection. Mr. Kiker, of Kikers-U-Pull-It, owns the property on both the north and south side of this portion of Delano Street. The purpose of the request is for customer safety, theft prevention, and the prevention of other inappropriate activities that have taken place on the roadway between the two Kiker-owned parcels.  

Staff has reviewed the request. Transportation and Traffic Operations staff cannot support the request due to insufficient room for vehicles to turn around in what will become the new terminus of the roadway. Stormwater management staff have no objections but do recommend that the property owner make drainage provisions within the area. All utility companies in the area have been contacted. AT&T, Emerald Coast Utilities Authority (ECUA), Gulf Power and Pensacola Energy require an easement in the petition area. Pensacola Energy also has a natural gas main in the area. If the request is approved, Pensacola Energy has agreed to cut and cap the existing gas main at the expense of the petitioner. The petitioner and his agent have been made aware of all concerns and are willing to create a cul-de-sac at what will be the new terminus of Delano Street.

All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION:

Once the Public Hearing has been scheduled, the petitioner will be notified, the date and time will be advertised, and all owners of property within 500 feet will be notified. It will be the responsibility of the petitioner or his agent to place the advertisement and to notify the property owners.
