RECOMMENDATION:
Recommendation Concerning the United States Department of Agriculture Natural Resources Conservation Service Emergency Watershed Protection Program for Motley Court Clear Creek Gulley - Joy Jones, P.E., Public Works Department Director
 
That the Board take the following action concerning the United States Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) Emergency Watershed Protection (EWP) Program for Motley Court Clear Creek Gulley:
 
A. Approve and Authorize the County Administrator to execute the United States Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) Emergency Watershed Protection (EWP) Program for Motley Court Clear Creek Gulley Grant Agreement #NR184209XXXXC038, for Motley Court Clear Creek Gulley Improvement Project;
 
B. Authorize staff to pursue acquisition easements, subject to legal review and sign-off, including any Agreements, Hold Harmless Agreements, or other documents of conveyance as may be required from the property owner; and
 
C. Authorize the County Administrator to execute, subject to Legal review and sign-off, any subsequent Agreements and program-related documents for this project that do not alter the finite terms of funding amounts or budgets.

This project is located in Commission District 5.
BACKGROUND:
At the September 21, 2017, Board of County Commissioners meeting, the Board authorized submittal request of the Motley Court Clear Creek Gulley project to NRCS for consideration of grant eligibility and funding under the EWP.    
 
At an additional regularly-scheduled board meeting on June 21, 2018, the Board authorized the County Administrator to sign United States Department of Agriculture Natural Resources Conservation Service Emergency Watershed Protection Program forms, as necessary to finalize the Grant Funding Award.
 
This drainage way is located within a 30’ unopened right-of-way starting at the North end of Motley Court, along the East boundary of Boulder Creek subdivision, 1st Addition, and extending approximately 1700 linear feet to Clear Creek.  This open ditch has eroded into a meandering gulley, ranging in varying widths from 10’ to 40’ wide, depths of 3’ to 20’, and extends into property owned by the University of West Florida (UWF). At one location along the gulley, an almost vertical slope has been identified adjacent to a property owner’s privacy fence on Crooked Oak Drive. Should this gulley be left unattended, damage to waterline utilities located in the unopened right-of-way, damage to private properties and home improvements, and continued degradation of eroded sediment in Clear Creek is imminent.
 
It will be necessary to acquire easements from UWF and one private property owner for the project to proceed.
 
NRCS has presented a grant agreement for county execution to address improvements within the gulley.
 
The total estimated cost for this project is $837,203.40. The EWP program reimburses 75% of the actual eligible construction cost, a total of $646,929.90. The County’s obligation for this project is estimated at 25% ($190,273.50.)
BUDGETARY IMPACT:
Funding for the 25% match comes from Fund 352, Local Option Sales Tax III, Cost Center 210107, Object Code 56301, Project 08EN0068, $250,000.
LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney’s Office has reviewed the agreement and signed-off for legal sufficiency.
PERSONNEL:
Public Works Department / Engineering Division staff will manage this grant.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board policy Section 11.A requires Board approval of grants.
IMPLEMENTATION/COORDINATION:
The Public Works Department will coordinate with the United States Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS).
