RECOMMENDATION:
Recommendation Concerning the Acquisition of Real Property Located at 10010 Bristol Park Road for the Bristol Park - Ashbury Hills Area Project - Joy Jones, P.E., Public Works Department Director

That the Board either approve, by super majority vote, or deny the following action:
 
A. Authorize the purchase of real property located at 10010 Bristol Park Road from Emory G. and Dana Jo Shelley, for the Bristol Park - Ashbury Hills Area Project for $329,000, which is the average of the County's appraised value of $320,000 and the owner's provided appraisal of $338,000;

B. Authorize County staff to draft the Contract for Sale and Purchase for the acquisition of real property (approximately 0.77 acres) located at 10010 Bristol Park Road, from Emory G. and Dana Jo Shelley, and to bring the executed Contract back before the Board; and 

C. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute, subject to Legal review and sign-off, any documents necessary to complete the acquisition of this property without further action of the Board (if the purchase is approved).

This Property is located in Commission District 5.
BACKGROUND:
Meeting in regular session on December 8, 2016, the Board approved staff to pursue the acquisition of properties that are listed within the Hazard Mitigation Grant Program (HMGP) and located along Eleven Mile Creek.

According to the FEMA Hazard Mitigation Grant Program Homeowner Acquisition Fact Sheet, the property owners can appeal the county's appraisal if they believe it is not adequate. The appeal process does include a second appraisal of their home at the property owner's expense. The county will then split the difference of the initial appraisal and second appraisal to determine the fair market value of the property, after which the county may make another offer.

Mr. and Mrs. Shelley are willing to sell their property, located at 10010 Bristol Park Road, in Bristol Park Subdivision, along Eleven Mile Creek. Per county policy, Escambia County staff had two appraisals performed on this property, which valued the property at $320,000 and at $285,000. The property owners have provided their own appraisal, which revealed a value of $338,000. 

The Shelleys have appealed, with a request to average the county's highest appraisal of $320,000 and their appraisal of $338,000, for a proposed purchase amount of $329,000.

Funds spent toward this project, and in accordance with the guidelines, are eligible for reimbursement.
BUDGETARY IMPACT:
Funding is available in Fund 352, “LOST III,” Cost Center 210120, Object Code 56101, Project #16EN3595. Funds spent toward this project are eligible for reimbursement through the grant.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Contract for Sale and Purchase will be reviewed and approved by Stephen West, Senior Assistant County Attorney. The County Attorney's Office will prepare the closing documents and conduct the closing for the purchase of this property.
PERSONNEL:
All work associated with this acquisition is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
