RECOMMENDATION:
Recommendation Concerning the Acceptance of a Portion of Real Property from Harvesters Federal Credit Union - Joy Jones, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a portion of real property, located in the 3200 Block of Blue Angel Parkway, from Harvesters Federal Credit Union:

A. Accept the Warranty Deed donating a portion of real property, located in the 3200 Block of Blue Angel Parkway, from Harvesters Federal Credit Union; and

B. Authorize the Chairman or Vice Chairman to accept the Warranty Deed, as of the day of delivery of the Warranty Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

This property is located in Commission District 1. 
BACKGROUND:
Harvesters Federal Credit Union currently owns parcel 08-2S-31-1000-000-009, which is located in the 3200 Block of Blue Angel Parkway south of Country Manor Estates Subdivision. The portion of the parcel that is being donated to Escambia County is the 30-foot wide strip of land that runs north and south, starting at lots 8 and 9 of Santa Clara Subdivision, then lying between Country Manor Estates Subdivision and Bayou Place Subdivision, and terminating at the centerline of Bayou Marcus Creek. 

Escambia County does currently have a 30-foot easement in this area, recorded in OR Book 647 Page 790. This donated property will give the county ownership of the existing easement area.

Funds associated with the recording of this document are available in the Engineering Escrow Account.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Warranty Deed was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, county staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the Warranty Deed recorded in the public records of Escambia County, Florida.
