RECOMMENDATION:
Recommendation Concerning the National Fish and Wildlife Foundation Project Funding Agreement for Bayou Chico Restoration Projects - Keith T. Wilkins, Director, Department of Natural Resources Management

That the Board take the following action concerning the National Fish and Wildlife Foundation (NFWF) Project Funding Agreement for Bayou Chico Restoration Projects:

A. Accept and approve the National Fish and Wildlife Foundation Project Funding Agreement (NFWF Project ID #45910), in the amount of $11,032,250, for Bayou Chico Restoration Projects;

B. Authorize the Chairman to sign the Project Funding Agreement and any subsequent Agreement-related documents, including no-cost extensions, pending Legal review and approval, without further action of the Board; and

C. Authorize staff to begin the process of obtaining necessary easements, parcels, and permits to complete the Bayou Chico Restoration projects.

[Funding:  This Grant will increase the Budget in Fund 118, Gulf Coast Restoration Fund, in the amount of $11,032,250.  A matching contribution from Escambia County of $2,183,000 has been identified under a Florida Department of Environmental Protection 319 Grant ($750,000) which will be set up in Fund 110, Other Grants and Projects, and in Fund 352, LOST III, Cost Center 210107, Transportation & Drainage, Project 08EN0272, Beach Haven ($1,433,000)]
BACKGROUND:
The funds to be awarded to Escambia County by the National Fish & Wildlife Foundation (NFWF) represent a portion of payments received by NFWF pursuant to plea agreements entered as judgment from BP Exploration and Production, Inc., and Tranocean Deepwater, Inc.  The funds are to be used by NFWF to fund projects to remedy harm to resources where there has been injury to, or loss of use of, those resources resulting from the Deepwater Horizon Macondo Oil Spill.  The Bayou Chico Restoration projects include five stormwater treatment and stream restoration projects to improve water quality and habitat in Bayou Chico, as well as support planned restoration activities identified in the Florida Department of Environmental Protection’s “Bayou Chico Basin Management Action Plan.”  Expected outcomes include improved benthic habitat quality, increased biological diversity and productivity, and improved water quality to assist in achievement of the Total Maximum Daily Load (TMDL) for the Bayou.  The five projects funded by this Agreement include two projects in the City of Pensacola (Bill Gregory Park Stormwater Project and R Street at Maggie’s Ditch Stormwater Project), the Beach Haven Northeast Stormwater Project, the Jackson Creek Stream Restoration Project, and the Jones Creek Stream Restoration Project.
BUDGETARY IMPACT:

LEGAL CONSIDERATIONS/SIGN-OFF:
This Agreement has been approved as to form and legal sufficiency by Kristin Hual in the County Attorney’s Office.
PERSONNEL:
The Bayou Chico Restoration projects will be managed by Escambia County staff from the Community & Environment Department’s Water Quality & Land Management Division and the Public Works Department.
POLICY/REQUIREMENT FOR BOARD ACTION:
The Comprehensive Plan requires Board of County Commissioners approval of grant agreements.
IMPLEMENTATION/COORDINATION:
Staff from the Community & Environment Department’s Water Quality & Land Management Division will coordinate management of these projects with the Escambia County Public Works Department, the City of Pensacola Public Works Department, and the Florida Department of Environmental Protection.
