RECOMMENDATION:
Recommendation Concerning Final Plat Cardinal Cove Permit FP# 20041535PSD-FP

That the Board take the following action concerning recording Cardinal Cove (an 81-lot residential subdivision), located in the Ferry Pass Community, lying south of Interstate 10 and west of Hillburn Lane at Hillburn Grove a subdivision recorded in Plat Book 15, Page 34 and east of Robin’s Ridge 1st Addition a subdivision recorded in Plat Book 18 at Pages 58 and 58A of the Public Records of Escambia County, Florida. Cardinal Cove is owned and developed by SNS Iron Rock, LLC. Prior to recording the County Surveyor and the Clerk of the Circuit Court must sign the subdivision plat as set forth in Section 2-5.7, of the Escambia Land Development Code; also, prior to recording the County Surveyor must sign the Final Plat as set forth in Chapter 177.081 (1) Florida Statute:

A. Approve the subdivision plat for recording in the Public Records;

B. Approve the street names “Cardinal Cove Lane and Cardinal Cove Court”;

C. Accept all public easements, ponds, drainage improvements within public easements and right-of-way as depicted upon the subdivision plat for permanent County maintenance; the cost of maintenance is to be funded through the establishment of a storm water management Municipal Services Benefit Unit (MSBU);

D. Accept public Parcels “I” and “J” located along Carpenter Creek as depicted upon the subdivision plat to support local conservation efforts within the watershed;

E. Authorize the County Administrator to execute an IRS Form 8283, subject to Legal sign-off; and

F. Authorize Chairman or Vice Chairman to execute a Two-Year Warranty Agreement without Surety.
BACKGROUND:
The Preliminary Plat and Construction Plans were approved on August 14, 2019. The Escambia County Public Safety Department approved the street names “Cardinal Cove Lane and Cardinal Cove Court” on June 17, 2019. Development Services Department field staff inspected the improvements on June 22, 2020, and found improvements substantially complete and in accordance with applicable County Requirements. An executed Two-Year Warranty Agreement without Surety will be recorded with the subdivision plat. County staff has reviewed and approves plat.  

Escambia County is in the process of developing a RESTORE Pot 1 funded watershed masterplan for Carpenter Creek and Bayou Texar. Conservation of floodplain wetlands within the riparian corridor will be one of the tenets of the plan. The Board has supported local conservation efforts within the Carpenter Creek watershed by acquiring two parcels located near the headwaters of the creek at 715 East Olive Road and the 7600 block of Winodee Road. The combined acreage of the parcels acquired to date is 13.38 acres. Public acceptance of wetlands and adjacent riparian areas within Cardinal Cove would add an additional 15.98 acres to the conservation lands within the Carpenter Creek watershed previously acquired by the Board. By accepting these areas, the owner is asking for tax donation credits. The property owner has been advised to discuss this with their accountant, to which IRS Form 8283 has been submitted.
LEGAL CONSIDERATIONS/SIGN-OFF:
This recommendation is consistent with previous practices of the County Attorney’s Office. The Two-Year Warranty Agreement without Surety was reviewed and approved by Kia Johnson on June 25, 2020.
PERSONNEL:
All work associated with this recommendation was done in-house and no additional staff was required.  Future Road Department budgets will reflect additional cost to maintain these improvements, if any.
POLICY/REQUIREMENT FOR BOARD ACTION:
Based on Escambia County Land Development Code – with regards to providing procurement for surety to warrant subdivision improvements (Ord. #2002-9) and the Florida State Plat Act - Chapter 177.
IMPLEMENTATION REQUIREMENTS:
Once the subdivision plat has been approved by the Board and final sign-off given by the County Surveyor, the plat shall be transmitted to the Clerk of Court’s Office for Clerk signatures and recording in the public records of Escambia County, Florida.
COORDINATION WITH OTHER AGENCIES/PERSONS:
Staff has been in contact with the developer, developer’s engineer and surveyor, County Engineer, County Surveyor, County Road Department, County Building Inspections and Development Services Department.
