Recommendation Concerning a Change Order on Contract PD 17-18.023 to American Consulting Engineers of Florida, LLC, for  Design Services for O.C. Phillips over Brushy Creek Bridge #484029 - Joy Jones, P.E., Engineering Department Director

That the Board approve and authorize the County Administrator to execute the following Change Order to American Consulting Engineers of Florida, LLC, for Design Services for O.C. Phillips over Brushy Creek Bridge #484029. Upon consultation with FDOT staff, it was determined that a Supplemental Agreement was needed for the additional scope of work which includes delineation of jurisdictional wetlands, additional survey; species surveys; submittal of mitigation strategies, agency verification, etc. The Supplemental Agreement was approved in regular session on May 21, 2020. The amount requested in the Supplemental Agreement, and for this Change Order, totals $79,524. Escambia County is responsible for 25% of the total cost ($19,881) and FDOT will reimburse the remaining 75% ($59,643):

BACKGROUND:
Meeting in regular session on September 7, 2017, the Board approved the Florida Department of Transportation (FDOT) Local Agency Program (LAP) Agreement for design of the bridge replacement located at O.C. Phillips Road (Bridge #484029).

Meeting in regular session on March 7, 2019, Escambia County entered into an Agreement with American Consulting Engineers of Florida, LLC, per the terms and conditions of PD 17-18.023 Design Services for O.C. Phillips Road over Brushy Creek Bridge #484029, FPN 430468-1-38-01, Federal No. (FAIN) D317-043-B.

In March 2020, during the 60% design and permitting phase, it became apparent that an individual permit would be required instead of a general permit because the wetland impacts would exceed the maximum allowed for a general permit. An individual permit requires a significantly greater level of effort than a general permit. Upon consultation with FDOT staff, it was determined that a Supplemental Agreement was needed for the additional scope of work. Additional work includes delineation of jurisdictional wetlands, additional survey; species surveys; submittal of mitigation strategies, agency verification, etc. The amount approved for the additional work totaled $79,524. The Supplemental Agreement was approved in regular session on May 21, 2020, and 25% will be funded by Escambia County ($19,881) and 75% by FDOT ($59,643).

Approval of this Change Order, #2, in the amount of $79,523.30, would authorize American to proceed with the additional services required by the Supplemental Amendment for the individual permit, including preparation and submission of the permit application package.
