Recommendation Concerning Contract Award for Title V Compliance Reporting and GCCS Design, Construction, and Maintenance for the Perdido Landfill - Patrick Johnson, Waste Services Department Director, through Paul Nobles, Purchasing Manager, Office of Purchasing

That the Board approve and authorize the County Administrator to sign the Agreement between Escambia County and Stearns, Conrad, and Schmidt, Consulting Engineers, Inc., d/b/a SCS Engineers, per the terms and conditions of PD 19-20.045, Title V Compliance Reporting and GCCS Design, Construction, and Maintenance for the Perdido Landfill, for a lump sum of $256,428, for a two-year term of professional services.

BACKGROUND:
EPA's Title V Clean Air Act Amendment Regulations 40 CFR 60, 61, and 63, along with EPA's Greenhouse Gas Reporting Program (GHGRP) 40 CFR Part 98, and FDEP Rule(s) 62-4, 62-204, 62-210, 62-213, 62-296 and 62-297, all require the collection, reporting, and storage of large amounts of landfill gas (LFG) data and records. An estimated 1500 professional service man hours are required for this compliance effort for the next two years. The scope of work includes, but is not limited to: Title V Air Operation Permit Renewal, Monthly Data Analysis, Semi-annual  Reports, Annual Title V Statement of Compliance, Annual Operating Report and Emission Estimate, Greenhouse Gas Reporting, and Landfill Gas System Phasing Plan.

Requests for Letters of Interest, PD 18-19.045 to Provide Title V Compliance Reporting and GCCS Design, Construction, and Maintenance for the Perdido Landfill, was issued via Government Forms Software on April 3, 2020. The solicitation was issued to 20 registrants representing 18 firms.

When solicited in 2018, only two responses were submitted. One was from Stearns, Conrad, and Schmidt, Consulting Engineers, Inc., d/b/a SCS Engineers, and the second from Geosyntec. SCS Engineers was granted the award. When re-solicited in 2020, only one response was recieved; that being from SCS Engineers. Both Geosyntec and HDR submitted a "No Bid" response. Their emails with their responses are included in the attachments. The increased scope of work coupled with the CPI of 2% compounded, put the total price at $256,428, as compared to $190,371, two years ago. The delta up of $66,057 was considered fair and reasonable by the evaluation committee, based on the increased scope and CPI escalation. Task #8 and #10 of the work scope are discretionary and require Department approval of scope and fee before proceeding. Utilization for these tasks will be based on the performance of the Gas Collection and Control System required for environmental compliance and electrical power generation Contract terms.

Negotiations were held with Stearns, Conrad, and Schmidt, Consulting Engineers, Inc., d/b/a SCS Engineers, on May 28, 2020, and on June 2, 2020. This resulted in a final negotiated total fee of $256,428 for a two year term of professional services.

This Recommendation is in compliance with the Code of Ordinances of Escambia County, FL 1999, Chapter 46, Finance, Article II Purchases and Contracts.
IMPLEMENTATION/COORDINATION:
The Office of Purchasing will issue the Attorney's Standard Form of Contract, Form G: Consulting Services for Stand Alone Projects.
