RECOMMENDATION:
Recommendation Concerning Legal Representation of County Employees.

That the Board amend its action of June 20, 2019 regarding the request for legal representation of County employees to allow payment of up to the $75,000 deductible on the County's EMS medical malpractice coverage to be used towards the legal representation of five County employees, with any amount over the deductible to be covered by County insurance.
BACKGROUND:
At its meeting on June 20, 2019, the Board authorized the retention of Attorney Ann Bittinger to represent multiple County employees facing investigation by the Florida Department of Health/Medical Quality Assurance.  This amendment would shift the cost center and also accommodate an anticipated higher cost based on the more complex nature of the second case.
BUDGETARY IMPACT:
The County Attorney's professional services line item has paid $19,000 to date.  This recommendation would allow future billing to be paid from the Risk Management reserve account 501/239898, until the insurance deductible is met.  After the deductible has been met, the insurance company will pay any further legal fees and expenses, should it be necessary.
