RECOMMENDATION:
Recommendation Concerning Federal Elections Security Grant Funding for the Office of the Supervisor of Elections - David H. Stafford, Supervisor of Elections

That the Board authorize the Chairman to sign the Certificate of Equipment for Casting and Counting Ballots.

In order to receive the Federal Elections Security funds, the Legislature has required that the Chairman of the Board of County Commissioners certifies that prior to the receipt and use of funds for the purchase of State-approved or certified emerging or enhancing software or hardware technology, the County has purchased and made available sufficient equipment for casting and counting ballots for the next regularly scheduled general election.
BACKGROUND:
Pursuant to the Appropriations Act of 2018 enacted on March 23, 2018, $380 million in grants were allocated to States to improve the administration of elections for Federal office for Fiscal Year 2018-2019.  These funds were distributed to the Supervisor of Elections pursuant to a formula subscribed in Sections 101 and 1043 of the Help America Vote Act (HAVA) of 2002 (Public Law 107-252). Of the original $15,450,000 allocation, a total of $2,344,003 was either not requested by Sub-recipients or was returned, with interest, unspent in a prior distribution of grant funds. These unrequested and returned funds remain available to Sub-recipients, pending the submission of this revised Grant Agreement.
BUDGETARY IMPACT:
In order to receive the federal election security funds, the Legislature has required the Chairman of the Board of County Commissioners certifies that prior to the receipt and use of funds for the purchase of State-approved or certified (which ever is applicable) emerging or enhancing software or hardware technology, the County has purchased and made available sufficient equipment for casting and counting ballots to meet the needs of County electors for the next regularly scheduled general election.
LEGAL CONSIDERATIONS/SIGN-OFF:
The documentation has been reviewed and approved by the County Legal Department.
PERSONNEL:
N/A
POLICY/REQUIREMENT FOR BOARD ACTION:
No County Supervisor of Elections shall receive funds pursuant to the Agreement until the Board of County Commissioners certifies to the Department of State the Certificate of Equipment of Equipment for Casting and Counting Ballots.
IMPLEMENTATION/COORDINATION:
This Agreement will be implemented by the Supervisor of Elections.
