RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Vacation of a Portion of Opened Right-of-Way Known as Hatton Street, Between "U" Street and "V" Street - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding a Petition to Vacate a Portion of Opened Right-of-Way known as Hatton Street, between "U" Street and "V" Street, as petitioned by Gross and Son Paint and Body Shop, Inc., represented by Taylor Kelly, Agent:

A. Authorize the scheduling of a Public Hearing for September 5, 2019, at 5:32 p.m., to consider the Petition to Vacate a Portion of Opened Right-of-Way known as Hatton Street, between "U" Street and "V" Street, approximately 55 feet x 300 feet, as petitioned by Gross and Son Paint and Body Shop, Inc., represented by Taylor Kelly, Agent; and

B. Require the Petitioner to notify all property owners within a 2500-foot radius.

The real property mentioned in this Petition to Vacate is located in Commission District 3.
BACKGROUND:

The Petitioner, who has properties on the north and south sides of Hatton Street, has submitted a Petition to Vacate for Hatton Street between "U" Street and "V" Street for the safety of their employees, who must cross Hatton Street repeatedly throughout the workday. The Petitioner states that some motorists do not heed the stop signs or the speed limit signs, causing danger to his employees. If this Petition to Vacate is approved, the Petitioner intends to install a cantilever gate system that would prevent through traffic along Hatton Street, which would improve employee safety during daytime business hours. 

The Petitioner has submitted a Stormwater Narrative, which states that, if the petition is approved, the Petitioner will maintain the two stormwater ditch bottom inlets, the underground piping, and the asphalt roadway in the petition area. Engineering staff has no objection to the request.  

The Public Safety Department does have concerns, as they do with all petitions to vacate local streets, due to access for emergency vehicles and fire supply lines. The Petitioner states that although the cantilever gate would be closed during hours of operation and open when the business is closed, the gate will not be locked, which would allow access for utility companies and emergency/rescue services at all times. The Petition would also install signs stating "No Through Traffic."  

Planning and Zoning Department staff have no zoning concerns but will need the Petitioner to attend a DRC review if this Petition to Vacate is approved.

Gulf Power, AT&T, Emerald Coast Utility Authority, and Energy Services of Pensacola all wish to retain their respective easements which lie within the petition area.  

BUDGETARY IMPACT:
Indirect staff cost associated with the preparation of documents and recommendation.

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands Policy for Closing, Vacating and Abandoning County-Owned Property — Section III and Florida Statutes, Chapter 336.
IMPLEMENTATION/COORDINATION:
Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all owners of property within the area determined by the Board will be notified.
