RECOMMENDATION:
Recommendation Concerning the Acquisition of Real Property Located at 5548 Glass Drive - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the acquisition of real property (0.92 acre, more or less) from Connie Shirah Hetherington, a/k/a Connie Pearl Shirah Hetherington:

A. Authorize the purchase of a parcel of real property located at 5548 Glass Drive (0.92 acre, more or less), from Connie Shirah Hetherington, a/k/a Connie Pearl Shirah Hetherington, for the purchase price of $47,000;   

B. Approve the Contract for Sale and Purchase for the acquisition of a parcel of real property located at 5548 Glass Drive (0.92 acre, more or less); and

C. Authorize the County Attorney's Office to prepare and the Chairman or Vice Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the acquisition of this property without further action of the Board.

This parcel is located in District 1.

BACKGROUND:
Following the April 2014 storm event, the area of Blue Springs Avenue within the Crescent Lake subdivision suffered significant damage to public infrastructure and private properties. Escambia County responded with the Crescent Lake Dam Project (funded by National Resources Conservation Services), Blue Springs Avenue FEMA repair project, and East Shore Drive FEMA outfall pipe replacements to Crescent Lake.

Given the extent of damage, the Blue Springs Avenue at Clearwater Avenue Drainage Analysis was also completed to identify drainage deficiencies and determine the best alternatives to mitigate future re-occurrence of such drainage impacts. Stormwater attenuation improvements in the upstream basin contributing to the Blue Springs Avenue area were determined necessary in the area of Sun Valley Drive, Glass Drive, and Clearwater Avenue. Potential stormwater improvements for Empire Pit were also referred to Florida Department of Transportation for consideration. The recommended alternative is to maximize the stormwater pond volume, depending upon successful property acquisition.

This parcel, adjacent to Crescent Lake Subdivision, is necessary to accommodate construction of a stormwater management system, for flood reduction, and to improve water quality for Crescent Lake.

Meeting in regular session on March 1, 2018, the Board accepted the counteroffer of $47,000. When the counteroffer was accepted, the parcel was owned by Windell Jones Life Estate and Connie Shirah Hetherington. Since then, the parcel was deeded to Connie Shirah Hetherington, a/k/a Connie Pearl Shirah Hetherington.  
BUDGETARY IMPACT:

Fund 352, LOST III, Cost Center 210107, Object Code 56101, Project #15EN3252 "Crescent Lake."

LEGAL CONSIDERATIONS/SIGN-OFF:
The Contract for Sale and Purchase has been reviewed and approved by Stephen West, Senior County Attorney. The County Attorney's office will prepare the closing documents and conduct the closing for the purchase of this property.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
