RECOMMENDATION:
Recommendation Concerning Defense Infrastructure Grant Agreement with the Florida Department of Economic Opportunity - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board take the following action concerning a Defense Infrastructure Grant Agreement #S0114 for Fiscal Year 2018-2019 between the State of Florida Department of Economic Opportunities and Escambia County:

A. Approve and authorize the Chairman to sign the Defense Infrastructure Grant (DIG) Agreement #S0114 with the State of Florida Department of Economic Opportunities (DEO), in the amount of $375,532.21, to augment existing planning, engineering, and regulatory permitting funds for the Pensacola Bay Living Shorline Project at Naval Air Station (NAS) Pensacola that has matching funding from the Gulf Coast Ecosystem Council for this project; and

B. Authorize the Chairman to sign any subsequent Grant-related documents, including no-cost extensions, pending Legal review and approval, without further action from the Board.

Note:  The County Attorney's Office has requested that the Board be made aware of the following language within the Agreement, Page 2, ¶F. 1. Which requires venue for any action arising out of or relating to the agreement in the appropriate state court in LEON COUNTY.

BACKGROUND:
Section 288.980(5), Florida Statutes (F.S.), establishes the Florida Defense Infrastructure Grant Program, the purpose of which is to support local infrastructure projects deemed to have a positive impact on the military value of installations within the state. Funds are to be used for projects that benefit both the local community and the military installation.

The NAS Pensacola Bay Living Shoreline Project will protect the Command Mission of NAS Pensacola. The Command Mission of NAS Pensacola is to efficiently deliver the very best Readiness From The Shore by fully supporting the operational and training missions of assigned tenants, enhancing the readiness of the U.S. Navy, its sister armed services and other customers. The NAS Pensacola Bay Living Shoreline Project will enhance homeland security and resiliency at NAS Pensacola through the creation of emergent and/or submerged breakwaters demarking the Military Exclusion Zone in Pensacola Bay. When constructed, the breakwaters will create a physical barrier between the Exclusion Zone and the shore of NAS Pensacola. The project’s dual goals of protecting the Command Mission of NAS Pensacola and improving aquatic habitat and water quality are mutually beneficial for NAS Pensacola and Escambia County.
BUDGETARY IMPACT:

LEGAL CONSIDERATIONS/SIGN-OFF:
The Grant Agreement has been reviewed by Kristin Hual, Senior Assistant County Attorney, and approved as to form and legal sufficiency.
PERSONNEL:
Natural Resources Management staff will manage the Grant.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board Policy Section II.A requires approval of grants.
IMPLEMENTATION/COORDINATION:
Natural Resources Management Department staff will manage the grant. The project has been coordinated with the Natural Resources Management Department, NAS Pensacola, and Florida DEO.
