RECOMMENDATION:

Recommendation Concerning Amendment No. 1 to the Florida Department of Environmental Protection Agreement No. RES04 for the Beach- Haven-Joint Stormwater & Wastewater Improvement Project Phase II - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board approve and authorize the Chairman to sign Amendment No. 1 to the Florida Department of Environmental Protection Agreement No. RES04 for the Beach-Haven-Joint Stormwater & Wastewater Improvement Project Phase II, to correct discrepancies in the Grant Agreement and clarify the total funding at $5,610,003.

BACKGROUND:

DEP Agreement RES04 was approved at the Board’s September 7, 2017, regular meeting. It was later discovered there were discrepancies in the grant amount award within the Agreement on two pages. This Amendment No. 1 will correct the discrepancies and clarify the total funding at $5,610,003.

BUDGETARY IMPACT:

Funding: Fund 118, Gulf Coast Restoration Fund, new cost center to be determined at the time of SBA.

LEGAL CONSIDERATIONS/SIGN-OFF:

Kristin Hual, Assistant County Attorney, reviewed and provided legal sign-off on Amendment No. 1 to the DEP Agreement No. RES04.

PERSONNEL:

No additional impact on personnel associated with this recommendation.

POLICY/REQUIREMENT FOR BOARD ACTION:

Board Policy II.B.8.

IMPLEMENTATION/COORDINATION:

Department of Natural Resources Management staff will coordinate with the County Public Works Department, FDEP, ECUA, and other entities to implement the terms of the Agreement and Amendment.
