RECOMMENDATION:
Recommendation Concerning the Florida Department of Environmental Protection Permission to Enter Property Located at 3100 Pace Boulevard (Former Vick's Cleaners at McDonald Plaza) - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board approve and authorize the Chairman to sign the Florida Department of Environmental Protection (FDEP) Permission to Enter Property Agreement, related to County-owned property located at 3100 Pace Boulevard, former Vick's Cleaners (ERIC ID# ERIC_4664 former Facility ID # 179801095) at McDonald Plaza, to conduct an environmental site assessment during which soil and groundwater will be sampled; monitoring wells will be installed; and, if necessary, remedial action of the soil and groundwater will be done under the State-administered cleanup of the FDEP Drycleaning Solvent Cleanup Program, pursuant to Section 376.3078(3), Florida Statutes (F.S.).
BACKGROUND:
In January 2017 Escambia County (the County) purchased the McDonald Plaza property located at the southeast corner of Pace Boulevard and Fairfield Drive for the location of the new County Jail. The Plaza was developed in circa 1960s as a multi-shop retail complex. One of the shops operated as a drycleaner facility from 1962 until the early 1970s and, during operations, released contaminants which were subsequently reported to the State Department of Environmental Protection. During this time, the site was enrolled in the Florida State Drycleaning Solvent Cleanup Program (DCSP) based on Chapter 376, Florida Statutes. On September 14, 2017, the site was given a programmatic score of 119 thereby granting eligibility for immediate site cleanup. The DCSP program funds assessment and cleanup operations but requires the Property Owner to pay a $10,000 deductible. Funding is available from Fund 129/VCTC, Cost Center 370213.  This Permission to Enter Property agreement grants the State permission to enter the county property and conduct the cleanup as per the DCSP program.
BUDGETARY IMPACT:
In accordance with Section 376.3078, F.S., cleanup of this drycleaning solvent contaminated site be funded by the Florida Water Quality Assurance Trust Fund, minus a deductible payable to FDEP by the property owner (County). The deductible for this project site is $10,000. Funding is available from Fund 129, VCTC, Cost Center 370213.

The Florida Department of Environmental Protection Permission to Enter Property agreement was approved as to form and legal sufficiency by Stephen G. West, Senior Assistant County Attorney.
