RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Petition to Vacate a Portion of the Gulf Beach (aka Holiday Harbor) Plat - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action regarding a Petition to Vacate a portion of a subdivision:

A. Authorize the scheduling of a Public Hearing for November 30, 2017, at 5:33 p.m., to consider the Petition to Vacate a Portion of the Gulf Beach Plat (aka Holiday Harbor, Plat Book 6, Page 34), a subdivision recorded in Plat Book 4, Page 52, as petitioned by Thomas Bizzell, President of Holiday Harbor Marina, Inc.; and

B. Require the petitioner to notify all property owners within the Holiday Harbor Subdivision and those property owners that utilize Waterview Drive to access their property, in addition to all property owners within a 500-foot radius.
BACKGROUND:
Holiday Harbor Subdivision, Plat Book 6, Page 34, is comprised of Lots 136 and 137 of Gulf Beach Subdivision recorded in Plat Book 4, Page 52.

Holiday Harbor Subdivision is located off of River Road along the Intercoastal Canal. Holiday Harbor Marina is petitioning the county to consider the Request to Vacate lots 1, 2, 3, and 4, Block B, of the Holiday Harbor Subdivision (approximately 0.75 acres), as recorded in Plat Book 6, Page 34. The proposed vacation will allow the construction of additional parking for the Sunset Grill, which is located next to Holiday Harbor Marina. The new parking area will include the addition of 48 spaces, a 20-foot landscaped buffer on the north and east sides of the parking area, and a new stormwater area for the treatment of stormwater runoff on the developed area.

The vacation will not deny convenient access to any persons owning other parts of the subdivision, and should not negatively impact access along Waterview Drive.

The petitioner has been through a pre-app meeting with the Development Review Committee.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION:

Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all property owners within the subdivision(s) and/or within 500 feet will be notified.
