RECOMMENDATION:
Recommendation Concerning Rainbow Store No. 186 (McDonald Shopping Center) - Request for Month-to-Month Tenancy - Stephan Hall, Budget Manager, Management and Budget Services

That the Board consider whether to approve a request made by Rainbow Store No. 186, located in the McDonald Shopping Center, that they be allowed to enter into month-to-month tenancy with the County upon the expiration of their written Lease, which expires September 30, 2017.
BACKGROUND:
Rainbow Store No. 186 is 1 of 7 remaining tenants located in the McDonald Shopping Center.  They occupy the space located at 1821 W. Fairfield Drive, which is adjacent to Family Dollar.  This space is located in the main building and is not part of the Phase 1 demolition at the McDonald Shopping Center site.  Rainbow currently leases the space for $4,031.25 monthly. 

The County assumed a written lease agreement between Rainbow and Mr. Glenn McDonald upon the purchase of the McDonald Shopping Center.  This agreement is set to expire on September 30, 2017.  County staff sent Rainbow a "Notice of Non-Renewal of Lease" on June 30, 2017, via Certified Mail/Return Receipt Requested, which was verified by the United States Postal Service to have been delivered on July 13, 2017. 

Rainbow has made a request (attached) to enter into a month-to-month tenancy with Escambia County upon the expiration of their lease until such time the County deems that they can no longer stay.

This matter is coming before this Board to determine whether or not to approve this request so that staff can inform Rainbow whether they need to vacate the premises by September 30, 2017, as stated in the Notice of Non-Renewal of Lease.
BUDGETARY IMPACT:
Rainbow's monthly rent is $4,031.25.  Rent is due on the 1st of the month and is considered delinquent after the 10th of the month. 

Rainbow's payment history is provided below as information to the Board: 

February - Delinquent, February 17, 2017 - Notice of Default/ Failure to Pay Rent sent to Rainbow, (in this instance they actually paid the prior owner and he had to reimburse the County

March - Delinquent, March 13, 2017 - Notice of Default/ Failure to Pay Rent sent to Rainbow, Rent was received on March 20, 2017

April - Timely payment received April 4, 2017

May - Timely payment received May 2, 2017

June - Timely payment received June 5, 2017

July - Delinquent, July 14, 2017 - Notice of Default/ Failure to Pay Rent sent to Rainbow, Rent was received via Fed Ex on July 31, 2017

August - Timely payment received via Fed Ex on August 3, 2017
