RECOMMENDATION:
Recommendation Concerning the Florida Department of Environmental Protection Agreement, in the Amount of $5,967,000, for the Beach Haven-Joint Stormwater & Wastewater Improvement Project Phase II - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board take the following action concerning the State of Florida Department of Environmental Protection (DEP) Agreement No. RES04 between the State of Florida DEP and the Escambia County Board of County Commissioners, relating to the Beach Haven-Joint Stormwater & Wastewater Improvement Project Phase II:

A. Approve the DEP Agreement No. RES04, in the amount of up to $5,967,000, relating to the Beach Haven-Joint Stormwater & Wastewater Improvement Project Phase II (Implementation); and

B. Authorize the Chairman to sign the Agreement and any future amendments relating to no-cost extensions, subject to Legal review and sign-off, without further action of the Board.

The County Attorney's Office has requested that the Board be made aware of the following language:

Paragraph 33, (page 21 of 22), last sentence, "Any action hereon or in connection herewith shall be brought in Leon County, Florida."

BACKGROUND:
The Bayou Chico watershed has a long history of polluted stormwater runoff, wastewater inputs, and nutrient enrichment.  This Beach Haven Stormwater and Wastewater Improvement Project includes the design, permitting, construction, and monitoring of new stormwater treatment facilities, the removal of septic tanks, and the installation of new sewer infrastructure.  These activities in the Beach Haven community will improve water quality in Bayou Chico.
BUDGETARY IMPACT:
Fund 118, Gulf Coast Restoration Fund, new cost center to be determined at time of SBA. Match is $3,776,477 from LOST and ECUA.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Assistant County Attorney, reviewed and provided legal sign-off on the DEP Agreement No. RES04.
PERSONNEL:
No additional impact on personnel associated with this recommendation.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board Policy II.B.8.
IMPLEMENTATION/COORDINATION:
Department of Natural Resources Management staff will coordinate with FDEP and other entities to implement the terms of the Agreement.
