RECOMMENDATION:
Recommendation Concerning Amendment #1 to the Title Clearance Services Program Agreement with Legal Services of North Florida, Inc. - Tonya Gant, Neighborhood & Human Services Department Director

That the Board take the following action concerning Amendment #1 to the Title Clearance Services Program Agreement with Legal Services of North Florida, Inc.:

A. Approve Amendment #1 to the Title Clearance Services Program Agreement between Escambia County and Legal Services of North Florida, Inc., providing an additional $7,500 to the original Agreement, for a total contract amount of $52,500; and

B. Authorize the Chairman or Vice Chairman to execute the Amendment and related documents required to implement the program.

BACKGROUND:
On November 3, 2016, the Board approved an Agreement with Legal Services of North Florida, Inc. (LSNF) providing for $45,000 in Community Development Block Grant (CDBG) funding to provide legal services to help low and moderate income County residents secure clear title in order to remove barriers to their ability to improve or maintain their property, by becoming eligible for traditional financing or County/City rehabilitation programs. Cases include probate, quiet title, bankruptcy, and tax disputes. The Agreement also required attendance at community outreach events and/or provision of community workshops.

In July, staff received a request from LSNF for additional funding in the amount of $7500 (Exhibit I) as LSNF has expended all CDBG funds as of May. LSNF has served 100 individuals and families through the original funding, but additional funding is needed to help with expenses related to ongoing cases, many of which are still as a result of the February 2016 tornados. The Amendment (Exhibit II) provides for additional funds through the end of September for a total contract amount of $52,500.
BUDGETARY IMPACT:
Funding for this project is budgeted in Fund 120/2016 SHIP, Cost Center 370202. The Board originally approved $45,000 for Title Clearance Services utilizing CDBG funds in the 2016 HUD Annual Plan. The funding for the Amendment will come from 2016 SHIP administrative funds.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Amendment has been reviewed and approved by Kristin Hual, Assistant County Attorney.
PERSONNEL:
No impact to personnel.
POLICY/REQUIREMENT FOR BOARD ACTION:
Agreement Amendments require Board approval.
IMPLEMENTATION/COORDINATION:
Neighborhood Enterprise Division will oversee the implementation of this project in conjunction with LSNF.
