Recommendation Concerning the Authorization for the Acquisition of Real Property for the Jackson Creek Restoration Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action to give further direction regarding the acquisition of two real properties located in Wesleyan Terrace 1st Addition Subdivision for the Jackson Creek Restoration Project:

A. Authorize staff to make an offer to the following property owners.  Market Value amounts and verbal counter offers are indicated below:

B. Authorize staff to draft the Contract for Sale and Purchase for the acquisition of real property located in Wesleyan Terrace 1st Addition Subdivision, and bring the executed Contract back before the Board; and

C. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute, subject to Legal review and sign-off, any documents necessary to complete the acquisition of these properties without further action of the Board (if the purchase is approved).

BACKGROUND:
In 2015, the National Fish and Wildlife Foundation (NFWF) officially awarded Escambia County over $11 million in RESTORE funding for construction of five projects within the Bayou Chico Watershed. Funds were awarded through NFWF to improve water quality and enhance wildlife habitat. Projects are located in all three of the main freshwater tributaries to Bayou Chico, including a floodplain restoration/expansion project to be located along Jackson Creek, which will likely require acquisition of one or more properties. Meeting in regular session on July 23, 2015, the Board authorized staff to begin the process of obtaining necessary easements, parcels, and permits to complete the NFWF-funded restoration projects.

Natural Resources Management staff has since completed an evaluation of potential project sites located along the creek to prioritize properties according to the specified restoration goals and grant-related metrics. Wesleyan Terrace 1st Addition was one of the recommended projects (item J in attachment - Jackson Creek Potential Projects)

An appraisal was previously performed on 13 parcels in Wesleyan Terrace 1st Addition Subdivision for properties under the Pepper Trust. Staff utilized the Pepper Appraisal to calculate offers to Mr. Schrader and to the Alabama Baptist Children's Home and Family Ministries.

Mr. Schrader's property is located at 5 Danbury Circle. Based off the previous Pepper Property Appraisals, staff looked at parcels in the cul-de-sac of both Beth Circle and Danbury Circle. These parcels are comparable to 5 Danbury Circle because of their irregular shape and size. By reviewing the comparative analysis of the the properties on Beth Circle and Danbury Circle, they were downgraded by 15% due to the irregular shape of the lot, and 25% for being flood prone, for a total adjustment of 40%, which gives a rate of $0.36/sf; the beginning base for all properties under review in the appraisal was $0.60/sf.  Mr. Schrader's lot is approximately 0.27 acres, which equates roughly to 11,761 sf, therefore giving an offer amount of $4,233.96.  Mr. Schrader informed staff of how much he would be willing to sell his property for when asked if he was willing to participate in this project. No formal offer has been made.
 
8 Beth Circle, owned by Alabama Baptist Children's Home and Family Ministries, is a standard, rectangular-shaped parcel. The comparative that staff used to base the offer from was a parcel located off Danbury Circle (Lot 28, Block B of Wesleyan Terrace 1st Addition). The Pepper Appraisal gave a standard, rectangular shape parcel with no adjustments (for lot shape or for being flood prone) $0.60 per square foot.  Per the plat of Wesleyan Terrace 1st Addition, 8 Beth Circle is 80 feet by 125 feet (10,000 sf). By multiplying the base cost and the square footage of this lot, the value would be $6,000.
BUDGETARY IMPACT:

Funding for this project is available in Funding Source:  Fund 352, "LOST III," Cost Center 210107, Object Code 56101 Project #13EN2382.

LEGAL CONSIDERATIONS/SIGN-OFF:
All documents will be reviewed by the County Attorney's Office for approval.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
