RECOMMENDATION:
Recommendation Concerning the Conveyance of an Anchor and Guy Easement to Gulf Power for County Property - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the conveyance of an Anchor and Guy Easement to Gulf Power for County property located south of the intersection of Chief's Way and Prieto Drive:

A. Approve granting an Anchor and Guy Easement to Gulf Power; and

B. Authorize the Chairman or Vice Chairman to sign the Anchor and Guy Easement.

[Funding Source:  Costs of incidental expenditures associated with the recording of documents will be borne by Gulf Power]
BACKGROUND:
Gulf Power currently has a project underway to upgrade their system so that they can accommodate the military's new electric system. Gulf Power's Engineering Department has plans to place a stub pole within the right-of-way of Chief's Way, which will require anchors and guy wires for installation. In order to complete this project, Gulf Power will need an Easement from the County for their anchors and guy wires. The County parcel that will be affected is located south of the intersection of Prieto Drive and Chief's Way, at the entrance to Corry Station. County staff has reviewed the request and has no objections to the Easement being granted, as long as the anchors and guy wires do not interfere with the Road Department's maintenance access. Gulf Power has indicated in the Easement Document that the anchors and guy wires will not extend more than fifteen feet onto the County's property. Board approval is required to convey the easement to Gulf Power. 
BUDGETARY IMPACT:
Costs of incidental expenditures associated with the recording of documents will be borne by Gulf Power.
LEGAL CONSIDERATIONS/SIGN-OFF:
The easement document was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
 
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the Easement executed by the Chairman and attested by the County Clerk’s office, with copies provided to Gulf Power Company for recording.
