RECOMMENDATION:

Recommendation Concerning the Criminal Justice User Agreement and the Memorandum of Understanding for Governmental Entity Access to the Driver and Vehicle Information Database System - Tammy Jarvis, Corrections Department Director

That the Board take the following action:

A. Approve the Criminal Justice User Agreement between Escambia County Corrections and the Florida Department of Law Enforcement and ratify the execution of the Agreement by Director, Tammy S. Jarvis; and

B. Approve the Memorandum of Understanding (MOU) between Escambia County Corrections and the Florida Department of Highway Safety and Motor Vehicles, relating to Governmental Entity Access to Driver and Vehicle Information Database System (DAVID), and ratify the execution of the MOU by Director, Tammy S. Jarvis.

BACKGROUND:

The Florida Department of Law Enforcement (FDLE) operates and regulates the Florida Criminal Justice Network (CJNet) as an intra-agency information and data-sharing network for use by the state’s criminal justice agencies and the Florida Crime Information Center (FCIC) for the exchange of information relating to crimes, criminals and criminal activity. The FDLE also serves as Florida’s Criminal Justice Information Services Systems Agency for the interstate transmission of Criminal Justice Information (CJI) to and from agencies in Florida and throughout the United States.

The Criminal Justice User Agreement sets forth the terms and conditions whereby Escambia County Corrections may have access to intrastate and interstate CJI systems provided by the FDLE through the CJNet and other systems accessed via the CJNet.

The Florida Department of Highway Safety and Motor Vehicles collects and maintains certain personal identifying information that is stored in the Department’s Driver and Vehicle Information Database System (DAVID). As an authorized governmental entity, the Escambia County Department of Corrections may utilize DAVID information for the purposes of carrying out its duties and functions as prescribed by law and as further described in the Memorandum of Understanding.

The Memorandum of Understanding sets forth the terms and conditions whereby Escambia County Corrections may utilize DAVID information.

The Agreement was reviewed and approved by Kristin D. Hual, Assistant County Attorney.

PERSONNEL:

Escambia County Corrections will administer the Agreements.

POLICY/REQUIREMENT FOR BOARD ACTION:

IMPLEMENTATION/COORDINATION:

Escambia County Corrections staff will coordinate with the Florida Department of Law Enforcement and the Florida Department of Highway Safety and Motor Vehicles for the administration of the Agreements.
