RECOMMENDATION:
Recommendation Concerning a Memorandum of Agreement with the Escambia County 4-H Foundation, Inc., for Construction of a Multipurpose Livestock Facility - Nicholas B. Simmons, County Extension Director

That the Board take the following action concerning a Memorandum of Agreement (MOA) between Escambia County, Florida, and the Escambia County 4-H Foundation, Inc.:

A. Approve the MOA between Escambia County, Florida, and the Escambia County 4-H Foundation, Inc., (MOA was approved by Foundation Board at their February 21, 2017 meeting) for construction of a Multipurpose Livestock Facility; and

B. Authorize the Chairman to sign the MOA.
BACKGROUND:
On April 29, 2014, the Board of County Commissioners approved the purchase of property at 5701 Highway 99, which was to be dedicated to 4-H youth education. Escambia County and Escambia 4-H Foundation, Inc., have determined it is in the best interest of the 4-H Youth Education Program to design and construct a Multipurpose Livestock Facility (hereinafter referred to as 'facility') on the property. Escambia County 4-H Foundation, Inc., will contribute $160,000.00 to fund the design and construction of the facility in accordance with the Scope of Work attached to the MOA.  This MOA was approved by the Escambia County 4-H Foundation, Inc., at their February 21, 2017, board meeting.
BUDGETARY IMPACT:
Escambia County 4-H Foundation, Inc., will contribute a sum of $160,000.00 to fund the design and construction of the Multipurpose Livestock Facility on the County's property.  The County is responsible for initiating, administering, and concluding the public procurement process for the Project.  Upon the Foundation's request, the County shall provide copies of all financial records relating to the Project.  Upon completion of the Project, any funds provided by the Foundation which are residual funds remaining unspent or unencumbered by any existing (not contingent) legal obligations related to the Project will be returned to the Foundation in the form of a negotiable instrument.  Title to all improvements on the Property that are related to the Project shall vest with the County.

County departmental staff will implement the terms of the MOA.
