RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage Easement at 2913 Buddys Lane - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of a Drainage Easement (approximately 0.06 acres) at 2913 Buddys Lane from Christen Rich:

A. Accept the donation of a drainage easement located at 2913 Buddys Lane from Christen Rich for drainage improvements;

B. Authorize the payment of documentary stamps considering the property is being donated for governmental use for drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Easement, as of the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
The County has a drainage repair project in design to alleviate chronic flooding issues at the intersection of LaRua Drive and Buddys Lane, where water standing in the low area at the intersection is causing flooding for local residents. The County was able to obtain, via donation, a Drainage Easement from Ms. Christen Rich, which is necessary to help convey stormwater from the roadway running south to the Gulf Power Easement. Plans will include a double inlet with a stormwater pipe along with a bubble-up structure that also has no bottom, which allows for filtration into the soil.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by the County Attorney's office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
