Issue: Action Item - Fee Resolution for Opting-Out of the Mid-West Escambia County Sector Plan

RECOMMENDATION:

Recommendation Concerning a Resolution Providing for Certain Reduced Fees and Other Provisions Related to Opting Out of the Mid-West Escambia County Plan.

That the Board review and adopt the fee schedule and the pertinent provisions contained therein and attached as Exhibit “A” to the Resolution.

BACKGROUND:

The Mid-West Escambia County Sector Plan was established in accordance with Florida Statutes 163.3245. This statute authorizes one or more local governments to engage in long-term planning for a large area, addressing regional issues through adoption of Detailed Specific Area Plans (DSAPs) within a planning area. In accordance with Section 2-7.4 of the Land Development Code and its applicable provisions, the adopted Escambia County Comprehensive Plan 2030 provides guidelines for removing properties from an approved DSAP in Chapter 16, FLU 16.6.1.V.

The Board has determined that it is appropriate to adopt alternative procedures for opting out of the Sector Plan, including but not limited to, options that would allow for a reduction in opt-out fees, simultaneous opting out of multiple parcels, and expedited processing where possible.

BUDGETARY IMPACT:

No budgetary impact is anticipated by the adoption of this Resolution.

LEGAL CONSIDERATIONS/SIGN-OFF:

The attached Resolution has been reviewed and approved for legal sufficiency by Kia Johnson, Assistant County Attorney. Any recommended legal comments are attached herein.

PERSONNEL:

No additional personnel are required for implementation of this Resolution.

POLICY/REQUIREMENT FOR BOARD ACTION:

The proposed Resolution is consistent with the Board’s goal “to increase citizen involvement in, access to, and approval of, County government activities.”
