RECOMMENDATION:

Recommendation Concerning Authorization to Terminate the Work Annex Commissary Agreement, PD 13-14.044 - William R. Powell, Director of Corrections

That the Board take the following action concerning the Work Annex Commissary Agreement, PD 13-14.044:

A. Authorize the termination of PD 13-14.044, effective March 31, 2020, in order to put this Agreement's termination in sync with the Jail's Inmate Commissary Agreement (PD 13-14.063); and

B. Authorize the County Administrator to sign the notice of termination.

BACKGROUND:

On April 14, 2014, the County issued an Invitation to Bidders (PD 13-14.044) seeking vendors to provide commissary services to the Escambia County Work Annex. On June 26, 2014, the County entered into an Agreement with Kimble's Food by Design, Inc., as a result of the solicitation. On June 6, 2019, the Board of County Commissioners approved the utilization of the final one-year renewal term provided for under this Agreement. This final one-year renewal term resulted in an extension that covers the period of June 26, 2019, to June 25, 2020. In order to create departmental efficiencies, it was determined that a solicitation which covers commissary services and inmate banking for the Jail and the Work Annex was needed. In order to facilitate the implementation of this combined solicitation (PD 18-19.102), it is necessary to terminate PD 13-14.044, effective March 31, 2020. Section 7 of PD 13-14.044 provides for the County's ability to terminate this Agreement for cause or convenience upon giving 30 days written notice.

LEGAL CONSIDERATIONS/SIGN-OFF:

Kristin Hual, Senior Assistant County Attorney, reviewed the initial Agreement. Termination of the Agreement as provided for in Section 7 of the Agreement does not require legal review.

Once authorized, the department will coordinate with the County Administrator's office to obtain the termination notice.
