RECOMMENDATION:
Recommendation Concerning Acquisition of Real Property Located on West Park Place for the Delano/Herman Streets Drainage Improvement Project - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the acquisition of real property (approximately 5.48 acres) located at 3330, 3360, and 3380 West Park Place, from Fairfield Drive Properties, LLC: 

A. Authorize the purchase of three parcels of real property located at 3330, 3360, and 3380 West Park Place (approximately 5.48 acres), owned by Fairfield Drive Properties, LLC, for the Delano/Herman Streets Drainage Improvement Project, for $1,400,000, in accordance with the terms and conditions contained in the Contract for Sale and Purchase;

B. Approve, by super-majority vote, the Contract for Sale and Purchase for the acquisition of three parcels of real property located at 3330, 3360, and 3380 West Park Place (approximately 5.48 acres) from Fairfield Drive Properties, LLC, for $1,400,000; and

C. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the acquisition of this property, without further action of the Board.

Funds spent toward this project are eligible for reimbursement through the HMGP. The additional acquisition cost ($165,000) will be covered by LOST III, Cost Center 210107, Object Code 56101, Project #12EN1763]

These properties are located in Commission District 3.
BACKGROUND:
Escambia County has a long history of stormwater drainage problems and frequent flooding in the Pace Boulevard/Herman Street/Fairfield Street/Delano Street areas, impacting government buildings, private facilities, and roadways. These parcels will be used to construct a stormwater pond. The stormwater ponds will be enhanced with landscaping and park-type amenities.

Following the April 2014 Flood Event, the Florida Department of Emergency Management (FDEM) approved funding for the design of a project to mitigate flooding in the Delano Street area. The design for the Delano Area Drainage Project has been completed, permitted, and submitted to FDEM for approval of grant funding for acquisition and construction.

The closings for all properties within the Delano Area Drainage Project will be scheduled once FDEM has approved acquisition and construction funding. This property owner is aware the closing will be delayed until then to comply with grant reimbursement requirements. 

The average of the two County-obtained appraisals is $1,235,000. Fairfield Properties', through communication of their attorney and the County's Legal Department, agreed to a purchase price of $1,400,000. Should the Board agree to their asking price, the acquisition is eligible for reimbursement up to the average of the County-obtained appraisals through the Hazard Mitigation Grant Program.  The additional acquisition cost ($165,000) will be covered by LOST III, Cost Center 210107, Object Code 56101, Project #12EN1763.

By approving the Contract for Sale and Purchase, the Board will also be accepting a Drainage Easement via the Warranty Deed (Exhibit B to the contract), which will be utilized to connect the future pond to the existing drainage system on Fairfield Drive.

This acquisition is necessary for the project and for the satisfaction of the grant requirements.
BUDGETARY IMPACT:

The additional acquisition cost ($189,500) will be covered by LOST III, Cost Center 210107, Object Code 56101, Project #12EN1763.

LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney's Office will review the closing documents and represent the County at the closing.  Seller's attorney will act as the closing agent pursuant to Section 10 of the Contract for Sale and Purchase.  The Contract for Sale and Purchase was approved as to form and legal sufficiency by Stephen G. West, Senior Assistant County Attorney, on August 28, 2019.

All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
