RECOMMENDATION:
Recommendation Concerning the Conveyance of Restrictive Easements to the United States By and Through the Department of the Navy - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the conveyance of the Restrictive Easements to the United States by and through the Department of the Navy:

A. Approve the conveyance of the following Restrictive Easements to the United States, by and through the Department of the Navy, in consideration for payment and otherwise pursuant to the terms of the Encroachment Protection Contribution Agreements:

B. Adopt, and authorize the Chairman to execute, the Resolutions approving the conveyance of the Restrictive Easements in accordance with the Encroachment Protection Contribution Agreements; and

C. Authorize the Chairman or Vice Chairman to execute the Encroachment Protection Contribution Agreements, Restrictive Easements, and any other documents necessary to complete the transaction.

The subject properties are located in Commission District 2.
BACKGROUND:
Meeting in regular session on September 22, 2016, the Board of County Commissioners entered into a Multi-Year Encroachment Protection Agreement for Naval Air Station (NAS) Pensacola (Agreement N69450-16-RP-00181) with the Department of the Navy. The purpose of this Agreement was to provide assistance with the acquisition of real property to prevent encroachment and limit incompatible development in the vicinity of NAS Pensacola. The Agreement provides 100% fair market value of the Restrictive Easement or 50% of the County's interest in the property, whichever is less. The stated match for the County's portion of this grant was the Defense Infrastructure Grant (DIG) program through the State of Florida.
 
At the June 6, 2019, regular meeting, the Board authorized the acquisition of three properties located at 613, 615, and 617 South Navy Boulevard. Temporary funding was provided from Local Option Sales Tax (LOST) III, in the amount of $142,876, to bridge a funding deficiency. These LOST III funds will be reimbursed through the sale of the Restrictive Easements which were acquired utilizing DIG funds. The Navy will also be purchasing Restrictive Easements on 621 South Navy Boulevard and the 4100 block of Blue Angel Parkway, parcels previously acquired with DIG funds. Surplus revenue from the sale of the Easements will be deposited into Fund 110 in a restricted account to leverage future DIG Grants (25% local match required).
BUDGETARY IMPACT:

Incidental expenses related to the sale of the easements will be covered by Fund 352, LOST III, Cost Center 220102, NESD Capital Projects, Object Code 56101, Project 19NE4188, Defense Infrastructure Match.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Restrictive Easements Encroachment Protection Contribution Agreements and Resolutions were approved as to legal form and sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
