RECOMMENDATION:
5:47 p.m. - A Public Hearing Concerning the Issuance of Additional Model Home Permits for Lost Key C-467 Townhomes

That the Board approve the issuance of building permits for construction of model townhomes within C-467 subdivision at Lost Key Golf & Beach Club. The C-467 preliminary plat has been approved through the Development Review Process. Civil construction has commenced on the C-467 subdivision and to provide additional assurances that the infrastructure will be completed the C-467 subdivision. WCI Communities, LLC, will provide Escambia County with a Surety Bond for the Civil development costs that have been certified by WCI's Engineer of Record. The development of the Townhomes is permitted pursuant to the terms of WCI Communities, LLC, Development Agreement with Escambia County.
BACKGROUND:
Pursuant to Section 4-7.13(b)(5) of the Land Development Code "Model homes," within any residential subdivision for which a preliminary plat has been approved by the county, the construction of no more than two principal dwellings for temporary use as model homes or real estate offices for the promotion and sale of lots or houses within the subdivision may be authorized prior to final plat approval. For the annual “Parade of Homes” event or other special circumstances the Board of County Commissioners (BCC) may authorize, at a public hearing, the issuance of additional model home permits if additional assurances of infrastructure completion are provided. However, issuance of a model home permit does not authorize issuance of a certificate of occupancy, and no permanent certificate of occupancy may be issued for any dwellings until the final plat is approved by the BCC and recorded as prescribed in Article 5 of Chapter 2. Additionally, the dwellings cannot be permanently occupied as residences until certificates of occupancy are issued. Any office use of a model home shall cease when sales within the subdivision have been completed.

WCI Communities, LLC, will provide Escambia County with a Surety Bond for the Civil development costs that have been certified by WCI Communities, LLC, Engineer of Record.
 
PERFORMANCE ASSURANCE BOND
Project Name: LOST KEY TRACT C 4 6 7 TOWNHOMES (PSD #171263PSD)

(“Principal”) and TBD a corporation certified to do business in the State of Florida as a surety insurer and duly organized under the laws of the State of TBD, with its home office located at TBD (“Surety”) are held and firmly bound unto Escambia County (“Beneficiary), a political subdivision of the State of Florida in the amount of $ 1,990,859.30  USD.
BUDGETARY IMPACT:
No budgetary impacts are expected as a result of the recommended Board action.
LEGAL CONSIDERATIONS/SIGN-OFF:
A copy of the recommendation has initially been provided to the County Attorney's office for review regarding compliance with the Florida Statutes and the Land Development Code.
PERSONNEL:
No additional personnel are required.
POLICY/REQUIREMENT FOR BOARD ACTION:
The recommendation is in compliance with LDC Section 4-7.13(b)(5) of the Land Development Code.
IMPLEMENTATION/COORDINATION:
This proposed recommendation was prepared by the Development Services Department and interested citizens. The Development Services Department will ensure proper advertisement.
