RECOMMENDATION:
Recommendation Concerning the Grievance Settlement Agreement and General Release.

That the Board take the following action:

A.  Approve the settlement of a grievance in the amount of $1,000 filed by the International Association of EMTs and Paramedics, Local R5-325; and

B.  Approve the Grievance Settlement Agreement and General Release by and between the Escambia County Board of County Commissioners, the International Association of EMTs and Paramedics, Local R5-325, and Jody Nezovich, and authorize the Chairman to sign the Agreement.
BACKGROUND:
On February 16, 2018, Jody Nezovich's employment with Escambia County Emergency Medical Services (EMS) was terminated for falsely reporting the facts and circumstances giving rise to a motor vehicle accident involving an EMS ambulance in which Nezovich was a passenger at the time of the collision.

On February 21, 2018, the International Association of EMTs and Paramedics (IAEP) Local R5-325 filed a grievance on behalf of Nezovich alleging wrongful termination without just cause in violation of the collective bargaining agreement between the IAEP and Escambia County. Escambia County denied the grievance, and the parties have not yet incurred the cost of proceeding with an arbitration hearing in the matter.

The consideration provided by Escambia County is in exchange for the full and final release of any and all claims alleged by or on behalf of Nezovich arising out of the subject grievance. The parties agree that Nezovich shall not be reinstated or considered for any other position of employment with Escambia County. By entering into the agreement, Escambia County expressly denies any liability or wrongdoing. It is understood that the consideration for this release is for the purpose of avoiding the expense and inconvenience of further proceedings in this matter. Each party to the agreement shall bear their own costs, attorneys' fees and expenses related to the resolution of the subject grievance.
