RECOMMENDATION:
Recommendation Concerning Acquisition of Real Property for the Myrtle Grove Elementary Pond Project - Joy Jones, P.E., Public Works Department Director

That the Board take the following action regarding the acquisition of a parcel of real property (approximately 0.3030 acres) located at 902 North 63rd Avenue from Annie Ruth Bryans:

A. Authorize the purchase of a parcel of real property located at 902 North 63rd Street (approximately 0.3030 acres), from Annie Ruth Bryans for the purchase price of $18,500, in accordance with the terms and conditions contained in the Contract for Sale and Purchase;

B. Authorize the Chairman to sign the Contract for Sale and Purchase for the acquisition of a parcel of real property located at 902 North 63rd Street (approximately 0.3030 acres), from  Annie Ruth Bryans, and

C. Authorize the County Attorney's Office to prepare and the Chairman or Vice Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the acquisition of this property without further action of the Board.

This project is located in Commission District 2.

BACKGROUND:
The Myrtle Grove Elementary Pond Project located in Branch K of the Warrington Basin Study is designed to alleviate chronic flooding issues at and around Myrtle Grove Elementary School and surrounding side streets near 61st and 63rd Avenue. The project will provide an overflow positive outfall route running west through a series of ponds and easements before eventually draining into the existing system along 65th Avenue, which was constructed with the Myrtle Grove Sidewalk Project. The county will need to acquire two more properties (one west of 65th Avenue) and one easement, to connect the existing school property to the new pond location.  
 
The Bryans' property, located at 902 North 63rd Avenue, a vacant residential property adjacent to the Myrtle Grove Elementary School, has been identified by our consultant engineer as one of the vital properties to be acquired for the success of this project. This property would provide a storage area and a conveyance for the upper Myrtle Grove Pond, and is necessary to allow for completion of the construction of the proposed pond and conveyance system. The school and surrounding residents will benefit from this regional stormwater infrastructure improvement.

This property is located in District 2.
BUDGETARY IMPACT:

Funding for this project is available from Fund 352, "Local Option Sales Tax III", Cost Center 210107, Object Code 56101/56301, Project # 09EN0572.   

LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney's office will prepare the closing documents and conduct the closing for the purchase of this property. The Contract for Sale and Purchase was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
