RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Petition to Vacate a Portion of Unopened Right-of-Way Known as Grande Boulevard - Joy Jones, P.E., Public Works Department Director 

That the Board take the following action regarding the Petition to Vacate a Portion of Unopened Right-of-Way known as Grande Boulevard:

A. Authorize the scheduling of a Public Hearing for March 7, 2019, at 5:31 p.m., to consider the Petition to Vacate a Portion of Unopened Right-of-Way known as Grande Boulevard (right-of-way varies due to the shoreline of Bayou Grande), as petitioned by George and Nita Omley; and 

B. Require the petitioner to notify all property owners within a 500-foot radius.

This request is located in Commission District 2.
BACKGROUND:
Grande Boulevard is an unopened right-of-way that meanders along Bayou Grande. The unopened portion of Grande Boulevard in this request is located in Block 23 of Beach Haven Subdivision.

The petitioners, George and Nita Omley, (Alfred J. Lojo, Esq., Agent), own the properties located at 2105 and 2109 Augusta Avenue. Mr. and Mrs. Omley purchased these properties in May 2018. A survey completed prior to the purchase indicated that a particular portion of the property, known as the unopened right-of-way of Grande Boulevard, shows no owner of record. The Escambia County Property Appraiser's Office was contacted to inquire about the area in question, at which time the agent and petitioners learned that a previous, approved Petition to Vacate completed in 1977 did not include this portion of unopened right-of-way in the legal description. The area included in this request has been fenced and occupied by the previous owner for more than 40 years. Due to this history, the Omleys are now requesting that this area be vacated by Escambia County.  

Staff has reviewed the request, with the only concern being approval of the Petition to Vacate waterfront property and future public access. All utility companies have been contacted and have no objections to approval of the Petition to Vacate this property.  

When the Petition to Vacate was submitted, the Omley's were represented by agent, Alfred J. Lojo, Esq.  Prior to requesting to schedule, the Omley's made the decision to move forward without agent representation.
BUDGETARY IMPACT:
Indirect staff cost associated with the preparation of documents and recommendation.
LEGAL CONSIDERATIONS/SIGN-OFF:
N/A
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County-owned property – Section III and Florida Statutes, Chapter 336.
IMPLEMENTATION/COORDINATION:
Once the Public Hearing has been scheduled, the Petitioners will be notified, the date and time will be advertised, and all owners of property within the area determined by the Board will be notified.
