RECOMMENDATION:
Recommendation Concerning Jacqueline Rogers v. Escambia County Board of County Commissioners; DEO Case No.: 18-034

That the Board accept for information the attached Determination of Consistency in the matter of Jacqueline Rogers v. Escambia County Board of County Commissioners, DEO Case No.: 18-034, in which the Department of Economic Opportunity found in favor of Escambia County and held that Escambia County Ordinance No. 2017-14 is consistent with the Escambia County Comprehensive Plan.
BACKGROUND:
On March 16, 2017, the Board of County Commissioners voted to adopt Ordinance 2017-14. The Ordinance amended the County's Land Development Code by creating Sec. 2-7.4, which established criteria regarding applications to opt-out of the Mid-West Escambia County Sector Plan.

A Petition challenging the Ordinance was timely filed with the Department of Economic Opportunity (DEO). A hearing was held on April 26, 2018. On May 10, 2018, a Determination of Consistency was entered by DEO, finding in favor of the County and holding that Ordinance 2017-14 is consistent with the Escambia County Comprehensive Plan.
