RECOMMENDATION:
5:32 p.m. Public Hearing for consideration of the vacation of a portion of an alleyway in Block 48, Figland Park Subdivision, as petitioned by Roy and Patricia Wade.
  
Recommendation:  That the Board take the following action regarding a Petition to Vacate a portion of an alleyway in Block 48, Figland Park Subdivision:

A. Approve or deny the vacation of a portion of an alleyway (20 feet x 100 feet) in Block 48, Figland Park Subdivision, as petitioned by Roy and Patricia Wade;

B. Accept the Hold Harmless Agreement;

C. Adopt the Resolution to Vacate; and

D. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.
BACKGROUND:
Petitioners Roy and Patricia Wade own the property south of the alleyway in Block 48 of Figland Park, formerly Fig City Townsite, as recorded in Plat Deed Book 87, page 244 of the Official Records of Escambia County, Florida. Block 48 is bordered on the north by West Ensley Street, West Devane Street to the south, Rawls Avenue to the west, and Pond Avenue to the east.  Mr. and Mrs. Wade are requesting that the Board vacate any interest the county has in a portion of a 20' wide alleyway (20 feet x 100 feet) located in Block 48. The request will not close the entire alleyway, just the length of the Petitioners' property.

Staff has reviewed the request and has no objections to the Vacation. All utility companies have been contacted and have no objections to the request. Gulf Power does have a pole located on the property that no longer provides services that they will remove. No one will be denied access to his or her property as a result of this Vacation.

Notifications were sent to the surrounding property owners within a 500' radius of the requested Vacation area.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board's Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County Owned property- Section III, and Florida Statues, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Vacation, the necessary documents will be signed and it will be the responsibility of the Petitioners to have the documents recorded in the public record and to advertise the required public notifications.
