RECOMMENDATION:
Recommendation Concerning the State of Florida Department of Transportation State-Funded Grant Agreement for County Road 184 (Muscogee Road) Phase IV-B Freight Corridor - FPN: 437039-4-54-01 - Joy Jones, P.E., Public Works Department Director

That the Board take the following action concerning the State of Florida Department of Transportation (FDOT) State-Funded Grant Agreement for County Road (CR) 184 (Muscogee Road) Phase IV-B Freight Corridor, FPN: 437039-4-54-01, for funding not to exceed $500,000, for the transportation improvements on CR 184 (Muscogee Road) Freight Corridor in Escambia County:

A. Adopt a Resolution authorizing the Chairman to execute the Agreement;

B. Approve, subject to Legal review and sign off, the State of Florida Department of Transportation (FDOT) State-Funded Grant Agreement for transportation improvements on CR 184 (Muscogee Road) Freight Corridor in Escambia County; and

C. Authorize the Chairman to sign the Agreement, the Resolution, and any other documents related to this project, subject to Legal approval, without further action of the Board.

[Funding:  A Supplemental Budget Amendment for the $500,000 will be prepared by the Office of Management and Budget to recognize the funding for the Agreement.  The local participation amount of $77,500 is available in the LOST III fund account associated with CR 184 (Muscogee Road) Corridor Improvements and connecting roadway]
BACKGROUND:
This project consists of roadway and minor drainage improvements along CR 184 (Muscogee Road), Phase IVB, from Booker Street to just west of CR 297A (0.50 miles). These improvements generally consist of mill and overlay of the existing road, installation of acceleration and deceleration tapers at side roads, 5' paved shoulders, minor ditch grading, driveway culvert replacement, guardrail, and minor utility adjustments. Right-of-way restoration will be accomplished by sodding. Erosion and sediment control will be utilized through construction.   

The estimated cost of the Project is $577,500, which is based on the Schedule of Financial Assistance in Exhibit "B".  FDOT agrees to participate in the project cost up to the maximum amount of $500,000 and additionally, the FDOT's participation in the project shall not exceed 100% of the total cost of the project.  Escambia County agrees to fund the local participation amount of $77,500.
BUDGETARY IMPACT:
A supplemental budget amendment for the $500,000 will be prepared by the Office of Management and Budget to recognize the funding for the Agreement.

The local participation amount of $77,500 is available in the LOST III fund account associated with CR 184 (Muscogee Road) Corridor Improvements and connecting roadway.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Sr. Assistant County Attorney, reviewed and approved the Resolution. The Agreement is subject to legal review and sign-off. 

Please note that the Agreement shall be governed and construed in accordance with the laws of the State of Florida. In the event of a conflict between any portion of the contract and Florida law, the laws of Florida shall prevail. The recipient agrees to waive forum and venue and the Department (FDOT) shall determine the forum and venue in which any dispute under this Agreement is decided.

IMPLEMENTATION/COORDINATION:
Upon Board approval of this Recommendation, the Chairman will need to sign the Agreement. The Clerk's Office will then need to certify the copy of the Resolution for FDOT and retain the original for the official records. Transportation and Traffic Operations staff will forward the Agreement and the certified copy of the Resolution to FDOT for final signatures and for their files. 

Engineering staff will continue to coordinate this project with FDOT, the Purchasing Department, (for procurement of a contractor), and will provide project management.
