RECOMMENDATION:
5:31 p.m. Public Hearing for consideration of the Petition to Vacate a Drainage Easement located between 12980 and 12990 Ogden Drive, on the Board's Own Motion.

Recommendation:  That the Board take the following action concerning the Petition to Vacate a drainage easement located between 12980 and 12990 Ogden Drive, on the Board's own motion:
  
A. Approve or deny the vacation of a drainage easement located between 12980 and 12990 Ogden Drive, on the Board's own motion;

B. Adopt the Resolution to Vacate; and

C. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.
BACKGROUND:
On August 26, 1997, the Board authorized staff to proceed with obtaining easements and/or property needed to construct road and drainage improvements along 66 county roads, including Ogden Drive. A 20-foot-wide Drainage Easement was required, and the property owners at 12990 Ogden Drive donated a 15-foot-wide Drainage Easement, located on the east side of the property line. The remaining five feet were obtained from the owners of the adjacent property, 12980 Ogden Drive. 

Drainage improvements that were made during the Hartung-Ogden Drainage Project in 2010 eliminated the need for the drainage pipe within the easement area. The pipe still functions for private downspout connection. Staff recommends that the Board vacate the abandoned Drainage Easement since it no longer serves a public purpose.  

Notifications were sent to the surrounding property owners within a 500' radius. 
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

This recommendation is based on the Board's Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County Owned property- Section III, and Florida Statues, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Vacation, the necessary documents will be signed and it will be the responsibility of county staff to have the documents recorded in the public record and to advertise the required public notifications.
