That the Board take the following action regarding a Petition to Vacate a portion of a subdivision:

A. Authorize the scheduling of a Public Hearing for March 15, 2018, at 5:33 p.m., to consider the Petition to Vacate a Portion of the Huntington Creek First Addition Plat, a subdivision recorded in Plat Book 19, Pages 34 and 34A, as petitioned by Clearwater 102, LLC; and

B. Require the petitioner to notify all property owners within a 500-foot radius, as well as, all property owners within the Huntington Creek and Twin Spires Subdivisions.
BACKGROUND:
Due to an oversight by Clearwater 102, LLC, their attorney, and their surveyor, a portion of the land owned by Clearwater 102, LLC, was dedicated to the Homeowners Association in the platting of Huntington Creek Phase I. The Homeowners Association deeded back to Clearwater 102, LLC, that portion of land as described in Official Records Book 7788, Page 209 (F-1) of the Public Records of Escambia County, Florida. All easements remain dedicated to Huntington Creek Phase I.

The purpose of this Vacation is to allow the lot owners in the proposed Subdivision Plat of Huntington Creek Phase II to retain individual lot ownership to the right of way of the private roadway being Huntington Creek Boulevard, with all easements remaining in place, as called for and platted in Phase I (the Vacation being of a portion of the first addition.)

The Vacation will not deny convenient access to any persons owning property within the area of said vacation. All easements granted in the first addition will remain in place.
